ORDINANCE NO. 2001-9- &408
AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH
PLANNING COMMISSION ON THE PROPOSED ZONING DESIGNATION FOR
PROPERTIES LOCATED BETWEEN NEW HOLT ROAD, PERKINS CREEK, U. S. 60 AND
HANSEN ROAD, AND AMENDING THE PADUCAH ZONING ORDINANCE SO AS TO
EFFECT SUCH REZONING
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That a resolution passed by the Paducah Planning Commission on
August 20, 2001, and entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF
THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONING
DESIGNATION FOR PROPERTIES LOCATED BETWEEN NEW HOLT ROAD, PERKINS
CREEK, U.S. 60 AND HANSEN ROAD," be approved as the final report of said Commission
respecting the matters therein set forth.
SECTION 2. That the zone classification and the map amendment proposed in
said resolution be, and the same are hereby, declared to be in agreement with the comprehensive
plan of the City of Paducah.
SECTION 3. That the zone classification B-3(General Business) be designated
for properties located between New Holt Road, Perkins Creek, U.S. 60 and Hansen Road, and
being more particularly described as follows:
Beginning at a point located at the intersection of the former
north right of way of Old Holt Rd and the south line of the Seyed
Ahmad & Firoozed D. Razban property (formerly Helen Stratton
Property D.B. 838, PG. 648; D.B. 517, PG. 288; D.B. 652, PG. 700);
thence South 80 degrees 46 minutes 00 seconds East along the said
Ahmad & Razban line, 261.51 feet to an existing iron pin (L.S. No.
1842) at the southwest corner of the WalMart Property D.B. 749,
PG. 16; P.B. K, PG. 16; thence South 80 degrees 46 minutes 00
seconds East along the south line of said Walmart tract, 525.56
feet to an existing concrete monument; thence continuing with
south line of said Walmart tract South 80 degrees 38 minutes 07
seconds East, 534.05 feet to an existing iron pin (L.S. No. 1955)
located at the southwest corner of the Auberndale Paducah Limited
Partnership Tract D.B. 890, PG. 276; D.B. 897, PG. 37; P.B. L,
PG. 55; thence South 80 degrees 40 minutes 38 seconds East along
the said south line of the Auberndale tract and tract 2 of the
Helen Garrett and Willa Sue Smith Property D.B. 727, PG. 406; P.B.
J, PG 795; P.B. J, PG. 1039, 1100.26 feet to a 36" blazed sycamore
tree located at the northwest corner of the Strawberry LLC tract
D.B. 906, PG. 36; thence South 7 degrees 49 minutes 46 seconds
West, 467.15 feet to the centerline of a ditch said centerline
being the north line of the Strawberry LLC tract, formerly the
Gerline Goodman Tract D.B. 702, PG. 33; thence along the
centerline of the ditch being said north line of Goodman Tract
described with the following chords:
North 45 degrees 17 minutes 04 seconds East, 156.31 feet;
North 87 degrees 50 minutes 53 seconds East, 51.66 feet;
South 57 degrees 54 minutes 13 seconds East, 40.46 feet to the
centerline of Perkins Creek; thence along the centerline of
Perkins Creek described with the following chords:
South 30 degrees 59 minutes 06 seconds West, 129.58 feet;
South 29 degrees 32 minutes 26 seconds East, 112.24 feet;
North 32 degrees 45 minutes 30 seconds East, 87.17 feet;

in the west right of way of un -named road; thence North 85
degrees 40 minutes 15 seconds West along the common lines of tract
11 and 21 of the Strawberry Hill Subdivision 36.85 feet to an iron
pin set this survey; thence North 4 degrees 09 minutes 29 seconds
East, 290.00 feet to an iron pin set this survey at the northeast
corner of tract 11; thence along the common line of tract 9 and
tract 11 North 85 degrees 40 minutes 15 seconds West, 443.81 feet
to an iron pin set this survey located at the intersection of the
north line of tract 11 and the east ROW line of Perkins Creek
Drive; thence North 81 degrees 00 minutes 03 seconds West, 50.17
feet to an iron pin set this survey located at the intersection of
the south line of tract 8 and the west ROW line of Perkins Creek
Drive; thence North 81 degrees 22 minutes 48 seconds West along
the common line of tract 8 and tract 12, 479.29 feet to an
existing iron pin (L.S. 2105) located at the northeast corner of
the Cornerstone Community Church property D.B. 785, PG. 800; P.B.
J, PG. 1034; thence along north line of said Cornerstone property
North 81 degrees 22 minutes 48 seconds West, 425.19 feet to an
existing 3/8" rebar located at the intersection of the Cornerstone
property and the Leo Brooking property D.B. 529, PG. 277; thence
North 4 degrees 04 minutes 13 seconds East along the east line of
the said Brooking property, Billy C. and Harriet Brown property
D.B. 542, PG. 570 & Elmer Leon Jr. & Juanita C. Henderson property
D.B. 489, PG. 520, 411.45 feet to an existing iron pin (L.S. No.
2105)at the northeast corner of said Henderson property; thence
North 81 degrees 20 minutes 59 seconds West along the north line
of said Henderson property, 354.16 feet to an existing iron pin
(L.S. 2105) located in the east line of Old Holt Rd.; thence with
the said east line of Old Holt Rd. North 4 degrees 38 minutes 07
seconds East, 340.12 feet to an existing iron pin (L.S. 2105);
thence North 88 degrees 04 minutes 20 seconds West, 49.84 feet to
a point located in the west ROW line of Old Holt Rd.; thence along
the west ROW of Old Holt Rd. North 29 degrees 44 minutes 44
seconds West 84.36 feet to a point located in the east ROW of New
Holt Rd.; thence North 85 degrees 56 minutes 31 seconds West,
104.05 feet to a point located in the west right of way line of
New Holt Rd.; thence, thence 179.27 feet along an arc to the left,
having a radius of 649.07 feet, the chord of which is North 36
degrees 50 minutes 19 seconds East, 178.70 feet to a point located
at the south line of the L & H Properties Inc. tract, D.B. 881 P.
24, thence, continuing with the said west right of way of New Holt
Rd. 209.44 feet along an arc to the left, having a radius of
649.07 feet, the chord of which is North 19 degrees 40 minutes 57
seconds East, 208.53 feet to a point located in the north line of
the said L & H Properties Inc. tract; thence, South 85 degrees 40
minutes 17 seconds East, 50.27 feet to a point located in the east
right of way of New Holt Road; thence along the said east right
of way of New Holt Road 53.74 feet along an arc to the left having
a radius of 699.07 feet, the chord of which is North 7 degrees 47
minutes 52 seconds East, 53.73 feet to the point of beginning.
The above described parcel contains 71.49 acres more or less as
surveyed by Florence & Hutcheson, Inc. in September, 1999 under
the supervision of Roger L. Colburn, KLS 3236.
SECTION 4. That if any section, paragraph or provision of this ordinance shall be
found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such
section, paragraph or provision shall not affect any other section, paragraph or provision hereof,
it being the purpose and intent of this ordinance to make each and every section, paragraph and
provision hereof separable from all other sections, paragraphs and provisions.
SECTION 5. This ordinance shall be read on two separate days and will become
effective upon summary publication pursuant to KR;
