HomeMy WebLinkAboutOrdinance Book 18, Page 615, Ordinance Number 74-6-990615 ORDINANCE NO. 74-6-990 AN ORDINANCE AMENDING SECTION 12-19 "NUMBER, RANK AND SALARIES OF MEMBERS" OF ARTICLE II "FIRE DEPARTMENT", OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY. WHEREAS, the 1974 Kentucky General Assembly enacted house Bill 477 which will require a computation of base hourly rates for certain employees for purposes of overtime payment for all hours worked in one work week in excess of forty (40) hours; and WHEREAS, pursuant to KRS 95.500 members of the fire department required to work a shift schedule of twenty-four (24) hours on duty and forty-eight (48) hours off duty are required to work an average of fifty-six (56) hours of duty per week, making overtime mandatory for such employees; NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That Section 12-19, "Number, rank and salaries of members," of Article II ,"Fire Department" of the Code of Ordinances of the City of Paducah, Kentucky, be amended and reordained so that said section as amended and reordained shall hereafter read as follows: "Sec. 12-19. Number, rank and salaries of members. (a) The number and rank of the members of the fire department of the city and their monthly salaries, provided such salaries are not changed by any annual apportionment ordinance hereafter adopted, shall be as follows: Position Number of Positions Base Monthly Salary Chief 1 1,125.00 Assistant Chief 3 870.00 Fire Marshall 1 775.00 Captain - (Training Officer) 1 745.00 Chief mechanic 1 745.00 Inspector 1 695.00 Firefighter (Assistant inspector) 1 570.00 Position Number of Positions Base Hourly Rate Captains 21 $2.687 Lieutenants 21 2.507 Firefighters 42 2.056 "(b) The assistant chiefs shall be paid at the rate of $870.00 per month until such time as they have completed seventeen years of service with the city, at the expiration of seventeen years of service they shall be paid at the rate of $875.00 per 616 month; and at the expiration of twenty years of service they shall be paid at the rate of $880.00 per month. "(c) Captain -Training - (Training Officer) shall be paid at the rate of $745.00 per month until he has served with the city for fourteen years, at the expiration of fourteen years he shall be paid at the rate of $750.00 per month; at the expiration of seventeen years he shall be paid at the rate of $755.00 per month, and for all months of service after twenty years he shall be paid at the rate of $760.00 per month. "(d) Chief mechanic shall be paid at the same rate per month as provided for the captain -training officer. "(e) The inspector shall be paid at the rate of $695.00 per month for all service through eleven years with the city; at the expiration of eleven years the rate of pay shall be $700.00 per month; at the expiration of fourteen years of service the rate of pay shall be $705.00 per month; at the expiration of seventeen years of service, and for all service thereafter, the rate of pay shall be $710.00 per month. "(f) Captains shall be paid at the rate of $2.687 per hour until he has served with the city for fourteen years; at the expiration of fourteen years he shall be paid at the rate of $2.705 per hour; at the expiration of seventeen years he shall be paid at the rate of $2.723 per hour; and for all months of service after twenty years he shall be paid at the rate of $2.741 per hour. "(g) Lieutenants shall be paid at the rate of $2.507 per hour for all service through eleven years with the city; at the expiration of eleven years the rate of pay shall be $2.525 per hour; at the expiration of fourteen years of service the rate of pay shall be $2.543 per hour; at the expiration of seventeen years and for all service thereafter the rate of pay shall be $2.561 per hour. "(h) Firefighters shall be paid at the rate of $2.056 per hour for the first six months; at the expiration of six months of service with the city the rate of pay shall be $2.218 per hour; at the end of one year of service the rate of pay shall be $2.254 per hour; at the end of the second year of service the rate of pay shall be $2.290 per hour; for all service between the third and fifth year the rate of pay shall be $2.326 per hour; for service between the fifth and eighth years, the rate of pay shall be $2.344 per hour; for all service between the eighth and eleventh years the rate of pay shall be $2.362 per hour; for service between the eleventh and fourteenth years the rate of pay shall be $2.380 per hour, and for all service beyond fourteen years the rate of pay shall be $2.398 per hour. "(i) Fire marshall shall be paid at the rate of $775.00 per month until he has served with the city for seventeen years; at the expiration of seventeen years he shall be paid at the rate of $780.00 per month; at the expiration of twenty years he shall be paid at the rate of $785.00 per month. 617 "(j) Firefighter (Assistant Inspector) shall be paid at the rate of $570.00 per month for the first six months; at the expiration of six months of service with the city the rate of pay shall be $615.00 per month, at the end of one year of service the rate of pay shall be $625.00 per month; at the end of the second year of service the rate of pay shall be $635.00 per month; for all service between the third and fifth years the rate of pay shall be $645.00 per month, for service between the fifth and eighth years, the rate of pay shall be $650.00 per month; for all service between the eighth and eleventh years the rate of pay shall be $655.00 per month; for service between the eleventh and fourteenth years the rate of pay shall be $660.00 per month, and for all service beyond fourteen years the rate of pay shall be $665.00 per month. (k)) All members of the fire department shall be paid an annual supplementary expense allowance for uniforms, meals, etc., in the amount of $360.00. Such sums shall be paid in quarterly installments of $90.00 on March 31, June 30, September 30 and December 31, and shall accrue at the rate of $30.00 per month. For the purposes of calculating a month, full credit shall be given after the fifteenth day. The expense allowances shall be paid on non -payroll checks, and shall not be subject to any deductions, except as may be required for taxes. "(1) In the event a member of the fire department acts in a position of responsibility higher than the position the member holds, and provided the period of responsibility is in excess of six hours during any work shift, the member shall be compensated as follows: Captain acting as assistant chief, $5.00; lieutenant acting as captain, $5.00; firefighter acting as lieutenant, $4.00. Such compensation shall be paid for any condition creating an absence within a position for which the acting officers are required to serve, including vacancy within the position, illness, vacations and holiday times, acting in another position, or temporary additional assignments. Such compensation shall not be paid for assignments resulting from members taking accumulated time, operating on work -back provisions, attending schools or seminars, or for any other reason than stated above. Acting pay shall be accounted for by the assistant fire chiefs and payment shall be made quarterly on March 31, June 30, September 30 and December 31. Acting pay shall be subject to all payroll deductions. "(m) Captains, lieutenants and firefighters shall be paid at the aforesaid hourly rates during each weekly period beginning on Monday and ending on Sunday for the first forty (40) hours of duty, and at one and one-half times said hourly rates for each hour of duty in excess of forty (40) . 018 SECTION 2. This ordinance shall not be construed to decrease compensation, police and firemen's retirement fund contributions or benefits, and so it is therefore expressly declared that payments for required work time in excess of forty (40) hours per week for members of a platoon working pursuant to the provisions of KRS 95.500 will be considered as normal or average pay and shall be specifically included for deductions and contributions to the police and firemen's retirement fund. SECTION 3. All ordinances and parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION 4. If any parts of this ordinance are for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance. SECTION 5. This ordinance shall be in full force and effect from and after the date of its adoption and retroactive to June 17, 1974.
