ORDINANCE NO. 73-1-752
AN ORDINANCE AMENDING AN ORDINANCE APPROVING AND PROVIDING FOR
THE EXECUTION OF A PROPOSED CONTRACT FOR AN URBAN MASS TRANSPORTATION
TECHNICAL STUDY GRANT FOR PROJECT NO. KY -T9-3 BETWEEN THE CITY OF
PADUCAH, KENTUCKY, AND THE UNITED STATES OF AMERICA
WHEREAS, the parties have entered into a Mass Transportation
Technical Study Grant Contract as of the 14th day of March, 1972,
pursuant to which the Public Body agreed to undertake a Mass
Transportation Technical Study Project and the Government agreed
to provide financial assistance to the Public Body in the form of a
Mass Transportation Technical Study Grant; and
WHEREAS, the purpose of this Amendment is to revise the Urban
Mass Transportation Technical Study Grant Contract to conduct and analyze
postal card surveys throughout the City and at a number of special
generators to determine the transit market;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE
CITY OF PADUCAH, KENTUCKY:
SECTION 1. That in consideration of the mutual promises herein
set forth, the parties hereto agree that the Mass Transportation Technical
Study Grant Contract shall be amended as follows:
Sec. 2 is modified as follows:
"The Proiect - The Public Body agrees to undertake, carry out, and
complete the technical studies comprising the Project substantially as
described in its Application filed with, and approved by, the Government,
and herewith incorporated by reference, and in accordance with the terms
and conditions of this Contract. This project is to assist in the formulation
of a transit development program and in evolving recommendations for the
future operation of transit service in Paducah; and to conduct and analyze
postal card surveys throughout the City and at a number of special generators
to determine the transit market."
SECTION 2. That Sec. 3 is modified as follows:
"The Grant - In order to assist the Public Body in financing
the cost of the Project, which cost is estimated to be Twenty -One Thousand
Dollars ($21,000), the Government will make a Grant in an amount equal to i
two-thirds of the actual cost of the Project, as determined by the Department
of Transportation (DOT), or in the amount of Fourteen Thousand Dollars

($14,000), whichever is the lesser."

SECTION 3. The obligation of the Government to make Federal Grant
payments in any fiscal year shall not exceed the amount provided
in the Project Budget for the fiscal year in which requisitions
therefor are submitted.
SECTION 4. This Amendatory Agreement may be simultaneously executed
in several counterparts, each of which so executed shall be deemed to
be an original, and such counterparts together shall constitute one

and the same instrument.
SECTION 5. An emergency is declared to exist and this ordinance
shall therefore be .introduced and remain on file for public inspection
for at least one week in the completed form in which it shall be put
upon its final passage, and if adopted shall be in full force and effect
immediately thereafter.
