AN ORDINANCE DECLARING THE PROPERTY KNOWN AS ELMWOOD
CEMETERY AND LOCATED WITHIN THE CORPORATE LIMITS OF THE CITY OF
PADUCAH, KENTUCKY, TO BE ABANDONED, AND AUTHORIZING THE CORPORATION
COUNSEL TO INSTITUTE SUIT PURSUANT TO KRS 381.720
WHEREAS, in the opinion of the Board of Commissioners of the City of
Paducah, Kentucky, the property known as Elmwood Cemetery has been for a number
of years abandoned, and
WHEREAS, the land comprising the said cemetery is now needed for a
valid public purpose by the Urban Renewal and Community Development Agency, and
WHEREAS, the City of Paducah, Kentucky, has, by virtue of the authority
of KRS 381.720, the power to institute suit for the vesting of the title of the aforesaid
cemetery in the City, or any governmental agency created by it pursuant to or by
the authority of the Kentucky Revised Statutes.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS
OF THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the property known as Elmwood Cemetery and more
particularly described as follows, is declared to be abandoned:
Beginning at a point in the west line of Tully Sheet, said
point being 330 feet north of the northwest corner of the
intersection of Tully Street and Yeiser Street; thence
westerly at a right angle to Tully Street a distance of
216.08 feet to a point; thence at a right angle northerly
a distance of 210 feet to a point; thence at a right angle
and easterly a distance of 216.08 feet to the said west
line of Tully Street; thence southerly along the west
line of Tully Street a distance of 210 feet to the point
of beginning, being 1.042 acres of land, more or less.
Being a part of the same property conveyed to the Urban
Renewal and Community Development Agency of the
City of Paducah, Kentucky, by the Board of Education
of the Paducah, Kentucky Independent School District
by deed dated March 5, 1973, of record in Deed Book
549, page 437, in the McCracken County Court Clerk's
Office.
SECTION 2. The Corporation Counsel of the City of Paducah, Kentucky,
is authorized and directed, pursuant to KRS 381.720, to institute suit for the City of
Paducah, Kentucky, or other appropriate governmental agency, to have the aforedescribed
property declared abandoned and to vest title thereto in the name of Urban Renewal and
Community Development Agency.

SECTION 3. This ordinance shall be in full force and effect from and

after its adoption.
