ORDINANCE NO. 72-3-622
AN ORDINANCE AUTHORIZING THE CITY MANAGER AND CITY TREASURER
TO PURCHASE A 70 ACRE TRACT OF LAND FOR USE BY THE PUBLIC WORKS DEPARTMENT
OF THE CITY OF PADUCAH, KENTUCKY, AND PRESCRIBING THE TERMS AND CONDITIONS
UPON WHICH SUCH PURCHASE SHALL BE MADE
BE IT ORDAINED BY THE BOARD OFCOMMISSIONERS OF THE CITY OF
PADUCAH, KENTUCKY:
SECTION 1. That the City Manager and City Treasurer be, and
they are hereby authorized to pay the sum of $21,000.00 to Carl E. Schmitt
and his wife, Mable Lucille Schmitt, for the purchase of a 70 acre tract
of land in McCracken County, Kentucky, which is more particularly
described as follows, to -wit:
Situated on the Northerly side of the Lebanon Church Road
about six miles Southwesterly of the City of Paducah, and
beginning at a stake in the Southerly line of a tract or
parcel of land conveyed to M. V. Rucker by N. A. Thomasson
and wife by deed recorded in Deed Book No. 182, page 591,
in the office of the County Court Clerk of McCracken County,
Kentucky, which beginning point is South 85 degrees, 30 minutes
West 1320 feet from the Southeast corner of said Rucker tract;
thence with the line dividing said Rucker tract and the tract
hereby conveyed, North 85 degrees, 30 minutes east 1320 feet
to the Southeast corner of said Rucker tract; thence with the
Easterly line of the N. A. Thomasson tract, about South 3
degrees, 10 minutes East, 2382 feet, more or less, to a stake
in the line of the Lebanon Church Road; thence with the North-
erly line of said road, about South 85 degrees, 30 monutes
West, 1101 feet, more or less, to the southeast corner of the
Louis Wurtz tract, a stake; thence with the Easterly line
of said Wurtz tract, about North 3 degrees, 10 minutes west,
938 feet, more or less, to the Northeast corner of said Wurtz
tract; thence with the Northerly line of the said Wurtz tract,
about South 84 degrees West, a distance of 265 feet, more or
less, to the Southeast corner of a tract or parcel of land
conveyed to Melvin and Jane Gilbert by N. A. Thomasson and
others by deed dated February 10, 1949, and recorded in Deed
Book No. 275, page 485, in the aforesaid Clerk's office; thence
with the Easterly line of said Gilbert tract and continuing
on in a northerly direction parallel with the Easterly line
of U. S. Highway No. 45, or Paducah and Mayfield Road, and
1320 feet distant therefrom, and with the Easterly line of a
tract or parcel of land conveyed to J. D. Sparks by N. A.
Thomasson and others by deed dated April 13, 1949, and re-
corded in Deed Book No. 277, page 146, in the aforesaid Clerk's
office, a distance of 1444 Feet, more or less, to the point of
beginning, and containing about 75 acres, more or less.
Less and except the following described tract of land which
shall be retained by the grantors, which tract is more parti-
cularly described as follows: Beginning at a point at the
Southwest corner of the above described tract, which point is
on the northerly line of the Lebanon Church Road; thence in
an Easterly direction along the northerly right-of-way line of
the said Road four hundred (400) feet, more or less, to a point;
thence at a right angle and in a northerly direction five
hundred fifty (550) feet, more or less, to a point; thence at
a right angle and in a westerly direction four hundred (400)
feet, more or less, to the west property line of the grantors
tract from which this tract is excepted; thence in a southerly
direction and along the said property line to the point of
beginning, containing five (5) acres, more or less.

Being part of the property conveyed to the grantors by deed
dated April 9, 1956, of record in Deed Book 372, page 256,
McCracken County Court Clerk's office.
SECTION 2. The purchase shall be for an unencumbered,
marketable fee simple title to the property as described in Section 1
above, and the deed shall include a general warranty. All taxes shall
be paid through the year 1971.
SECTION 3. The purchase of the property is necessary for use
by the Public Works Department of the City of Paducah, Kentucky, for
operation of a sanitary landfill and also for the acquisition of
gravel and other materials.
SECTION 4. An emergency is declared to exist and this ordinance
shall therefore be introduced and remain on file for at least one week
for public inspection in the completed form in which it shall be put
upon its final passage, and if adopted shall be in full force and effect
immediately, thereafter.
