ORDINANCE NO. 72-2-608
AN ORDINANCE REPEALING AN ORDINANCE ENTITLED "AN ORDINANCE
ESTABLISHING A PARKS, PLAYGROUNDS AND RECREATION BOARD FOR THE CITY
OF PADUCAH, KENTUCKY, AND PRESCRIBING THE MEMBERSHIP, TERMS OF OFFICE,
POWERS AND DUTIES OF SUCH BOARD", AND REPEALING SECTIONS 22-15 AND
22-16 OF THE CODE OF ORDINANCES CITY OF PADUCAH, KENTUCKY, AND
AMENDING SECTIONS 22-13 AND 22-14 OF SAID CODE OF ORDINANCES
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF
PADUCAH, KENTUCKY:
SECTION 1. That an ordinance containing the title quoted above,
which was adopted by the Board of Commissioners on May 14, 1968, be,
and the same is hereby, repealed, together with Sections 22-15
"Officers; treasurer's bond." and Section 22-16 "Indebtedness
chargable to city's general fund; authorization of board of com-
missioners required."
SECTION 2. That Article II. "Parks, Playground and Recreation
Board Section 22-13. Created; powers; responsibilities," be amended
and reordained so as to hereafter read as follows:
Article II. Board of Park Commissioners.
Sec. 22-13. Created; powers; responsibilities.
Pursuant to KRS 97.405 to 97.485 there is hereby established
a Board of Park Commissioners to advise the Legislative Body of the
City on appropriate park and recreational programs end projects, and
to promote the full use of all park facilities in the interest of the
Public. The Board of Park Commissioners shall be an advisory board
only and after their appointment shall convene and elect a president
and a secretary, and shall establish rules not inconsistent with the
provisions of the Kentucky Revised Statutes.
SECTION 3. That Section 22-14. "Membership; appointment; term;
vacancies." of the Code of Ordinances City of Paducah, Kentucky, be
amended so that said section as amended and reordained shall hereafter
read as follows:
"Section 22-14. Membership; appointment; term, vacancies.
The Board of Park Commissioners shall consist of five (5).
members to be appointed by the Mayor with the approval of the Board
of Commissioners of the City of Paducah, Kentucky, for terms of four

(4) years, except the first appointments shall be one (1) member for
a term of one (1) year, one (1) member for a term of two (2) years,
one' (1) member for a term of three (3) years, and two (2) members
for a term of four (4) years. Any member of the Board may be removed
by a majority vote of the Board of Commissioners. vacancies shall be
filled in the same manner as original appointments and for the un-
expired term of the vacancy."
SECTION 4. Section 1 above repeals all terms and conditions
of Ordinance 68-5-61 which was adopted by the Board of Commissioners
on May 14, 1968, and the sections of said ordinance specifically
repealed by the repeal of Section 22-15 and Section 22-16 of the Code
of Ordinances of the City of Paducah are Section 3 and Section 4 of
said ordinance. Sections 2 and 3 above are in replacement of Sections
1 and 2 of Ordinance No. 68-5-61.
SECTION 5. All ordinances and parts of ordinances in conflict
herewith are, to the extent of such conflict, hereby repealed.
SECTION 6. If any section, paragraph or provision of this
ordinance shall be found to be inoperative, ineffective or invalid
for any cause, the deficiency or invalidity of such section, paragraph
or provision shall not affect any other section, paragraph or provision
hereof, it being the purpose and intent of this ordinance to make
each and every section, paragraph, section and provision hereof
separable from all other sections, paragraphs, sentences and provisions.
SECTION 7. This ordinance shall be in full force and effect
from and after 12:01 a.m., February 14, 1972.
