A RESOLUTION AUTHORIZING THE CITY MANAGER TO ADVERTISE FOR SALE
BY THE CITY OF PADUCAH, KENTUCKY, A FRANCHISE FOR A PERIOD OF TEN YEARS
AUTHORIZING THE PURCHASER TO OPERATE A REFUSE COLLECTION BUSINESS IN
THE CITY OF PADUCAH, AND TO OPERATE AND MAINTAIN A SANITARY LANDFILL
ON CITY PROPERTY, AND FIXING THE TERMS AND CONDITIONS OF SUCH GRANT.
BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF
PADUCAH, KENTUCKY:
SECTION 1. That the City Manager be, and he is hereby,
authorized to advertise for bids for sale by the City of Paducah, a
ten year franchise authorizing the purchaser to operate a refuse
collection business in the City of Paducah and to operate and maintain
a sanitary landfill on city property.
SECTION 2. Each:bidder shall state the amount he will pay to
the City of Paducah annually for a ten year grant and authorization
to have an exclusive right to collect refuse, rubbish, trash and garbage
for hire in the City of Paducah, Kentucky, which grant shall be subject
to the following requirements, restrictions and conditions:
(a) Routes - Each proposal shall state the number of routes
to be initially established, the minimum number of pickups to be provided
for each household or establishment per week, and all changes thereafter
shall be subject to the approval by the Board of Commissioners of the
City of Paducah.
(b) Services and rates - Each proposal shall state the type
of services that shall be provided, including such information as type
and number of containers to be allowed for minimum service and for
each degree of service above minimum, and for special services, and
each proposal shall state -what special services will be made available,
and each proposal shall state the rates to be charged for each type
service, and all changes shall be subject to approval by the Board of
Commissioners.
(c) Sanitation - All collections shall be performed in a
careful manner to avoid the spread of litter within the City of Paducah,
and all collections shall be so transported and disposed of as to
prevent the spread of litter, filth and disease within the City of
Paducah, and the successful bidder shall have the duty and responsibility
of exerting every reasonable effort to maintain the City of Paducah in
a clean and litter free manner, and the City of Paducah shall support

the successful bidder in this endeavor by cooperating in the enforcement
of all litter, junk and sanitation ordinances of the City and Statutes
of the Commonwealth of Kentucky.
(d) Landfill Operation - The successful_bidder.shall be
required to operate and maintain a sanitary landfill operation on city
property to be provided by the City in existing or hereafter acquired
locations to -be within five miles of the geographic center of the city
limits of the City of Paducah or within seven miles of any point within
the City, and the successful bidder, shall operate and maintain such
landfill in compliance with all laws of the United States and the
Commonwealth of Kentucky as may now exist or hereafter be adopted in
relation to sanitation, pollution and environmental control.
(e) Limitations - The successful bidder shall state what
limitations shall be placed against households and business establish=
ments and industries within the city relating to types of refuse to be
picked up, location of containers, etc.
(f) Insurance - The successful bidder shall be required to
provide and maintain liability insurance in the following minimum
amounts: $20,000.00, property damage; $100,000.00, personal injury
per person, and $300,000.00 personal injury per occurrence. The City
of Paducah shall be named as an additional insured in any policy.
(g) Bond - The successful bidder shall be required to provide
bond in the amount of $100,000.00 conditioned upon the faithful
performance of all the terms and conditions of the franchise.
SECTION 3. The City Manager shall advertise for sealed bids by
posting a notice at the City Hall door and by inserting notice of the
request for bids in the Paducah Sun -Democrat to be published not less
than seven days nor more than twenty-one days before the date fixed for
the opening of bids; in the Louisville Courier -Journal, a newspaper of
state wide circulation in the Commonwealth of Kentucky, and the Wall
Street Journal, mid -west edition. All bids shall be sealed and no bid
shall be received after the hour fixed in the notice for the opening of
same. All bids received by the City Manager up to the time fixed in the
notice for the opening of same shall be filed with the Board of Com-
missioners who may let a contract to the highest responsible bidder,
and the Board of Commissioners shall reserve the right to reject any
and all bids and the City shall not become legally obligated to any

bidder until the adoption of an ordinance authorizing the execution of
a purchase contract.
SECTION 4. This resolution shall be in full force and effect
from and after its adoption.
