ORDINANCE NO. 71-11-561
AN ORDINANCE ESTABLISHING RULES OF THE CITY OF PADUCAH, KENTUCKY,
PROVIDING FOR COMPULSORY RETIRKMENT OF MEMBERS OF THE POLICE AND FIRE
DEPARTMENTS OF THE CITY
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF
PADUCAH, KENTUCKY:
SECTION 1. Any member of the Police Department or Fire
Department of the City of Paducah, Kentucky, who, after the effective
date of this Ordinance, becomes sixty years of age and at that time
has completed at least twenty years of tital service in either of said
departments, and who is entitled to retirement and retirement annuity
benefits from the Policemen's and Firemen's Retirement Fund of the
City of Paducah shall be required to retire from such service and city
employment as such member at the end of the calendar month in which
he becomes entitled to such retirement and retirement annuity benefits.
SECTION 2. Any member of the police department or fire depart-
ment of the City of Paducah, Kentucky, who, at the effective date
of this ordinance is sixty or more years of age and as of that date
has completed at least twenty years of tital service in either of said
departments, and who is entitled to retirement and retirement annuity
benefits from the Policemen's and Firemen's Retirement Fund shall be
required to retire from such service and city employment as such member
at the end of the calendar month in which this ordinance becomes
effective.
SECTION 3. Any member of the Police Department or Fire Department
of the City of Paducah, Kentucky, who, at the effective date of this
ordinance is sixty or more years of age, and as of that date has not
completed twenty years of tital service in either of said departments,
shall not be required to retire from such service and city employment
as such member until the end of the calendar month during which he
completes twenty years of tital service as such member and becomes
entitled to retirement and annuity benefits from the Policemen's
and Firemen's Retirement Fund, at which time he shall be required to
retire from such service and city employment as such member.
SECTION 4. Any member of the Police Department or Fire Department
of the City of Paducah, Kentucky, who is able to perform his assigned
duties and has not been otherwise suspended or dismissed from service
as the result of disciplinary action, shill not be precluded from
serving at least twenty years as such member.
SECTION 5. All ordinances or parts of ordinances in conflict
herewith are, to the extent of such conflict, hereby repealed.
SECTION 6. If any section, paragraph or provision of this
ordinance shall be found to be inoperative, ineffective or invalid for
any cause, the deficiency or invalidity of such section, paragraph or
provision shall not affect any other section, paragraph or provision
hereof, it being the purpose and intent of this ordinance to make each
and every section, paragraph and provision hereof separable from all
other sections, paragraphs and provisions.
SECTION 7. This ordinance shall be in full force and effect
from and after its adoption.
