HomeMy WebLinkAboutOrdinances Book 17, Page 711, Ordinance Number 71-7-512ORDINANCE NO. 71-7-512 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE REZONING OF PROPERTY ON THE NORTHEAST SIDE OF YEISER STREET, SOUTH OF COOLEY STREET, AND AMENDING THE PADUCAH ZONING ORDINANCE -1971 SO AS TO EFFECT SUCH REZONING BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the Paducah Planning Commission on July 21, 1971, entitled "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED REZONING OF PROPERTY ON THE NORTHEAST SIDE OF YEISER STREET, SOUTH OF COOLEY STREET", be adopted as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the zone classification change and the map amendment proposed in said resolution be, and the same are hereby declared to be in agreement with the comprehensive plan of the City of Paducah. SECTION 3. That the zone classification of the following property be, and it is hereby, changed from R-3 Medium Density Residential Zone to M-2 Heavy Industrial Zone: Beginning at a point in the center line of Yeiser Street at the point of intersection of an existing M-2 and R-3 zone, said point being on a line between property known as 2204 and 2206 Yeiser Street, if extended to said center line; thence in a north- westerly direction along and with the center line of Yeiser Street a distance of 46 feet to a point, said point being the inter- section of the dividing line between 2204 Yeiser Street and 2200 Yeiser Street, if extended, and the center line of Yeiser Street; thence at right angles and along and with the dividing line between 2200 and 2204 Yeiser Street a distance of 185 feet to the center line of a 20 foot alley; thence at right angles and in a northwesterly direction along and with the center line of said alley a distance of 40 feet to a point, same being the point of intersection of the center line of said alley with the dividing line between 2200 and 2134 Yeiser Street, if extended; thence at right angles and in a southwesterly direction along and with the dividing line between 2200 and 2134 Yeiser Street a distance of 185 feet to a point in the center line of Yeiser Street; thence in a northwesterly direction and along the center line of Yeiser Street, where Yeiser Street has a width of 30 feet to the center line of Hays Avenue; thence in a southwesterly direction and along the center line of Hays Avenue 10 feet, more or less, to the center of the intersection of Hays Avenue and Yeiser Street as extended from the north- west; thence in a northwesterly direction and along the center line of Yeiser Street, now a 50 foot street, to a point in the center of the intersection of Yeiser Street and Cooley Street, a 60 foot street; thence in a northeasterly direction and with the center line of Cooley Street, 375 feet, more or less, to the existing M-2 and R-3 zone boundary line; thence in a south- 712 easterly direction and with the existing line of said zone boundary a distance of 295 feet, more or less, to the end of said boundary line and the point of intersection with the line dividing the existing M-2 and R-3 zones; thence in a southwesterly direction and along the property line to and including a 20 foot alley, a distance of 193 feet, more or less; thence in a southeasterly direction along the rear property line of 2204 Yeiser Street, a distance of 5 feet; thence in a southwesterly direction along said property line dividing 2204 and 2206 Yeiser Street and which line is the existing zone boundary between the M-2 and R-3 zones, a distance of 185 feet, more or less, to the point of beginning. SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 5. This ordinance shall be in full force and effect from and after its adoption.
