HomeMy WebLinkAboutOrdinances Book 17, Page 501, Ordinance Number 71-3-440501 ORDINANCE NO. 71-3-447 AN ORDINANCE AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A RIGHT-OF-WAY EASEMENT TO SOUTH CENTRAL BELL TELEPHONE COMPANY FOR RELOCATION OF UNDERGROUND TELEPHONE CABLE THROUGH PROPERTY OF THE CITY OF PADUCAH IN AND AROUND NOBLE PARK BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the Mayor and City Clerk be, and they are hereby, authorized to execute a right-of-way easement to South Central Bell Telephone Company in consideration of and for the purpose of relocation of underground telephone cable, which right-of-way easement shall be in words and figures as follows: "In consideration, the adequacy and receipt of which is hereby acknowledged from the South Central Bell Telephone Company, 534 Armory Place, Louisville, Kentucky, the undersigned owner(s) of the premises described below, do hereby grant to the South Central Bell Telephone Company, its licensees, agents, successors, assigns, and allied and associated companies, a right of way wasement to construct, operate, maintain, add or remove such lines or systems of communications or related services as the grantee may require, consisting of: (1) poles, guys, anchors, aerial cables and wires; (2) buried cables and wires, cable terminals, markers, splicing boxes and pedestals; (3) conduits, manholes, markers, underground cables and wires; (4) and other amplifiers, boxes, appurtenances or devices upon, over and under a strip of land 10 feet wide across the following lands in McCracken County, State of Kentucky, generally described as follows: Beginning at a point in Noble Park 50 feet, more or less, north of the center line of existing U. S. Highway 60 or Park Avenue, at a point on the line between the property of the Paducah Junior Chamber of Commerce and the City of Paducah at Station 11+48.4, and thence preceding along a straight line in a westerly direction to Station 41+40 at a point on the Paducah Floodwall, which point is approximately 60 feet north of the center line of said Park Avenue. and, to the fullest extent the undersigned has the power to grant, if at all, over, along and under the roads, streets or highways adjoining 502 or through said property. The following rights are also granted: to allow any other person or company to attach wires or lay cable or conduit within the right of way for communications or electric power transmission or distribution; ingress and egress to said premises at all times. To have and to hold the above granted easement unto South Central Bell Telephone Company, its successors and assigns forever." SECTION 2.
