HomeMy WebLinkAboutOrdinances Book 17, Page 482, Ordinance Number 71-3-442482 b ORDINANCE NO. 71-3-442 AN ORDINANCE AMENDING ARTICLE XVI "HUMAN RIGHTS COMMISSION" OF CHAPTER 2 OF THE CODE OF ORDINANCES CITY OF PADUCAH, KENTUCKY BY AMENDING SECTION 2-297 AND BY ADDING A NEW SECTION 2-305 BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That Article XVI "Human Rights Commission" of Chapter 2 of the Code of Ordinances City of Paducah, Kentucky, be amended by amending Section 2-297 "Receipt of Complaints; investigations; hearings; etc." so that said section as amended and reordained shall hereafter read as follows: "Sec. 2-297. Receipt of complaints, investigations; hearings; powers; etc. The Commission shall receive complaints, conduct investigations, hold hearings, make studies and have such studies made as will enable the commission to carry out the purposes of this article. The commission shall have the following powers in addition to those otherwise enumerated in this article: (1) Receive, initiate, investigate, hear, and determine charges of violation of ordinances, orders, or resolutions forbidding discrimination adopted by the Board of Commissioners of the City of Paducah. (2) Compel the attendance of witnesses and production of evidence before it by subpoena issued by the circuit court of McCracken County. (3) Issue remedial orders, after notice and hearing, requiring cessation of violation. (4) Employ an executive director, attorneys, hearing examiners, clerks and other employees and agents as are required to carry out the duties and powers of the commission." SECTION 2. Tjat Article XVI "Human Rights Commission'- of ommission"of Chapter 2 of the Code of Ordinances City of Paducah, Kentucky, be amended and reordained by adding the following new section: 483 "Sec. 2-305. Enforcement of Commission Orders. The proceeding for enforcement of a commission order is initiated by filing a complaint in the circuit court. Copies of the complaint shall be served upon all parties of record. Within thirty days after the filing of the complaint by the commission, or within such further time as the court may allow, the commission shall transmit to the court the original or a certified copy of the entire record upon which the order is based, including the transcript of testimony or as otherwise may be stipulated by all parties to the proceeding and as established by KRS 344.340 and the rules of civil procedure." SECTION 3. This ordinance shall be in full force and effect from and after its adoption. Mayor (� Passed by the Board of Commissioners.
