ORDINANCE NO. 71-3-440
AN ORDINANCE REZONING PROPERTY ON THE NORTH SIDE OF PARK AVENUE
EAST OF METCALF LANE IN THE CITY OF PADUCAH, KENTUCKY, FROM R-2 AND B-1
TO B-3 GENERAL BUSINESS ZONE
WHEREAS, on January 20, 1971, Paducah Planning Commission held
a hearing on the application for a zoning map change of the hereinafter
described property from an R-2 and B-1 zone to a B-3 zone, and
WHEREAS, after due consideration the Planning Commission denied
the application and reported its findings, and
WHEREAS, the Board of Commissioners of the City of Paducah has
been asked to consider the application, and
WHEREAS on February 23, 1971, at 7:30 p.m., the Board of Commission-
ers held a public hearing pursuant to notice and as required by law for
the purpose of obtaining evidence regarding the said application for a
zone change, and
WHEREAS, the Board heard all witnesses desiring to testify, and
received all evidence to be presented at said hearing, and continued
the action generally until March 9, 1971, and
WHEREAS, the Board has considered the facts and evidence and has
otherwise been sufficiently advised,
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE
CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Paducah Zoning Ordinance -1961 be amended to
change the Zoning Map and zoning classification of the following described
property from an R-2 Zone and a B-1 Zone to a B-3 Zone:
Tract 1 - R-2 to B-3
Beginning at a point in the center line of Park Avenue 315 feet east
of the intersection of the center line of Metcalf Lane with the center
line of Park Avenue, same being the point of intersection of the
center line of Park Avenue with the east line of Anderson & Roberts
and the west line of Rhodes and Wynn, if extended; thence in an
easterly direction with the center line of Park Avenue a distance of
355 feet, more or less, to the west line of the present B-1 zone;
thence in a northerly direction, along the dividing line between the
B-1 and R-2 zones a distance of 200 feet, more or less, to a point;
thence at right angles in an easterly direction along and with the
dividing line between the B-1 and R-2 zones a distance of 470 feet,
more or less, to a point in the east line of Rhodes & Wynn and the
west line of E. M. Bailey Distributing Company; thence in a northerly
direction and with the dividing line between Rhodes & Wynn and E. M.
Bailey and Gibson Stores, Inc. a distance of 1500 feet, more or less,
to the present city limits line; thence in a northwesterly direction
with the city limits line to the east line of Anglin property a
distance of 940 feet, more or less, this point being 353.5 feet from
the east line of Metcalf Lane measured with the city limits line;
thence in a southerly direction along the west line of the Rhodes &
Wynn property 2174.43 feet to the point of beginning.

Tract 2 - B-1 to B-3
Beginning at the point of intersection of the center line of Park
Avenue with the east line of Rhodes & Wynn (same being the west line
Of E. M. Bailey Distributing Company), if extended; thence in a
westerly direction along and with the center line of Park Avenue a
distance of 470 feet, more or less, to the present dividing line
between the B-1 and R-2 zones; thence at right angles and in a
northerly direction along and with the dividing line between the B-1
and R-2 zones a distance of 200 feet, more or less; thence at right
angles and in an easterly direction parallel with the center line of
Park Avenue and along the dividing line between the B-1 and R-2 zones
a distance of 470 feet, more or less, to a point in the common line
between Rhodes & Wynn property and E. M. Bailey Distributing Company;
thence in a southerly direction along said common line to the point
of beginning.
SECTION 2. This ordinance shall be in full force and effect from
and after its adoption.
