A RESOLUTION REQUESTING AND AUTHORIZING THE CITY MANAGER TO
ADVERTISE FOR BIDS FOR THE OPERATION OF A SANITARY LANDFILL ON PROPERTY
TO BE FURNISHED BY THE CITY FOR SUCH PURPOSES
BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF
PADUCAH, KENTUCKY:
SECTION 1. That the City Manager be, and he is hereby, requested
and authorized to advertise for bids for the operation of a sanitary
landfill on property to be furnished by the City of Paducah for such
purpose, and in so advertising he will use substantially the following
form:
INVITATION FOR BIDS
The City of Paducah, Kentucky, will receive bids for the
operation of a sanitary landfill to be located on property
provided by the City for such purpose, said bids being receivable
until 10 a.m., CST, on the 26th day of February, 1971, at the City
Hall Commission Chambers, Paducah, Kentucky, at which time and
place all bids will be publicly opened and read aloud.
The project shall consist of furnishing all labor and equipment
for the operation of the sanitary landfill and such other services
as are designated in the proposed contract to be entered into for
such service.
Contract documents are on file at the office of the City
Manager, City Hall, Paducah, Kentucky.
Copies of the contract documents may be obtained from the
City Manager upon request, but all applicable federal, state,
county and city laws applicable to the operation of a sanitary
landfill and incorporated in the contract documents by reference,
shall not be furnished, and the responsibility for compliance
and obtaining shall be the responsibility of the bidder.
The successful bidder shall be required to save the City
harmless from any and all claims or actions which might be
brought against it as a result of the operation of the sanitary
landfill, including the payment of any fines for failure to
comply with the sanitary landfill laws, and the successful
bidder shall be required to provide a performance bond in the
amount of $100,000.00 to guarantee the continuous and proper
performance. The successful bidder shall also be required to

provide liability insurance with the following minimum amounts;
$20,000.00 property damage; $100,000.00 personal injury,
individual, and $300,000.00 personal injury, each occurrence.
The City of Paducah shall be named as an additional insured.
The City of Paducah reserves the right to reject any and
all bids or to waive any informailities in the bidding.
Bids may be held by the City of Paducah for a period not
to exceed sixty (60) days from the date of the opening of bids
for the purpose of reviewing the bids, investigating the qualifica-
tions of the bidder and insuring that all necessary project
approvals are acquired and operating permits are obtained prior
to awarding the contract.
SECTION 2. The City Manager shall advertise for sealed bids by
posting a notice at the City Hall door and by inserting notice of the
invitation for bids in the Sun -Democrat to be published at least one time
not less than seven days nor more than twenty-one days before the date
fixed for the opening of bids. No bid shall be received after the hour
fixed in the notice for the opening of same. All bids received up
to the time fixed in the notice for the opening of same shall be filed
with the Board of Commissioners who may let a contract to the lowest
responsible bidder. Said Board shall reserve the right to reject any
and all bids, to waive informalities in the bidding, and the City
shall not become legally obligated to any bidder until the adoption
of an ordinance authorizing the execution of a contract.
SECTION 3. This resolution shall be in full force and effect
from and after its adoption.
