HomeMy WebLinkAboutOrdinances Book 17, Page 429, Ordinance Number 71-1-425429 ORDINANCE NO. 71-1-425 AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A LEASE FOR PROPERTY AT THE SOUTHWEST CORNER OF 9TH AND HARRISON STREETS, AND PRESCRIBING THE TERMS AND CONDITIONS OF SAID LEASE BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the Mayor be, and he is hereby, authorized and directed to execute a lease agreement on behalf of the City for the use of property Located at the southwest corner of the intersection of 9th and Harrison Streets from Mrs. Mildred Terrell Werner and Mrs. Marguerite Terrell Langstaff and her husband, Dr. Samuel Husbands Langstaff, said lease agreement being in words and figures as follows: "THIS LEASE made and entered into on this day of Decem- ber, 1970, by and between MRS. MILDRED TERRELL WERNER, unmarried, Lexington, Kentucky, and MRS. MARGUERITE TERRELL LANGSTAFF and her husband, DR. SAMUEL HUSBANDS LANGSTAFF, Littleton, Colorado, parties of the first part, and the CITY OF PADUCAH, Paducah, Kentucky, party of the second part, WITNESSETH: That for the consideration and upon the terms herein provided parties of the first part hereby lease to the party of the second part the following property: (Being in the City of Paducah, Kentucky) Located at the southwest corner of 9th and Harrison Streets; commencing at the southwest corner of the intersection of Ninth Street and Harrison Street, running thence in a south- erly direction along 9th Street an approximate distance of 163.25 feet to a 20 -foot alley bisecting 9th Street; thence in a westerly direction a distance of approximately 140 feet along the 20 -foot alley to the Illinois Central right-of-way; thence in a northeasterly direction an approximate distance of 188 feet among the.right-of-way to Harrison Street; thence in an easterly direction an approximate distance of 47 feet to the place of beginning. Being the same property conveyed to Mildred Terrell Werner and Margie (Marguerite) Terrell Langstaff by deed from Elizabeth T. Muir,•widow, dated June 25, 1969, recorded in Deed Book 510, page 399, McCracken County Court Clerk's Office. Terms and Rental: The term of this lease shall be five (5) years, commencing December 15, 1970, at an annual rental of Six Hundred ($600.00) Dollars, to be paid at the rate of $50.00 per month, payable in advance on the first of every month. 430 Use; The property hereby leased may be used for any lawful busi- ness operations of the City of Paducah. Default - Failure to pay any installment of rent within thirty (30) days after the same becomes due shall operate, at the option of the landlord and without demand or notice, to mature the unmatured rent for the remainder of the year in which such default occurs. Indemnity- The party of the second part agrees to hold first parties free and harmless from liability for any injury or damage to persons or prop- erty, resulting from the negligent use thereof by second party or from defects in or upon the premises; all of which such liability, if any, is hereby expressly assumed by the second party. Maintenance: The second party will not commit or permit any nuisance on said premises, nor any waste or negligent deterioration, and will be responsible for such maintenance as is necessary to keep the premises suitable for its purposes; and will deliver the leased premises to first parties at the termination of this lease, in as good condition as received, ordinary wear and tear excepted. Inspection: First parties shall have free access to the premises at all times for the purposes of inspection or examination, or other reasonable and lawful purposes, either personally or by their agent or representative. Holdover• At the termination of this lease, any extension of occupancy by first party shall be on a month-to-month basis only. Forfeiture• At the option of the first parties, this lease shall be void or forfeited in case of any violations of its terms by the second party. IN TESTIMONY, the parties have subscribed their names hereto in triplicate." SECTION 2_ An emergency is declared to exist, and this ordinance shall therefore be introduced and remain on file for one (1) 431 week for public inspection in the completed form in which it shall be put upon its final passage, and if adopted shall be in full force and effect immediately thereafter.
