HomeMy WebLinkAboutOrdinances Book 17, Page 37, Ordinance Number 70-2-28737 ORDINANCE NO. 70-2-287 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE REZONING OF PROPERTY ON THE NORTH SIDE OF HINKLEVILLE ROAD WEST OF THE FLOODWALL, AND AMENDING THE PADUCAH ZONING ORDINANCE -1961 SO AS TO EFFECT SUCH REZONING BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the Paducah Planning Commission on February 4, 1970, entitled "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED REZONING OF PROPERTY ON THE NORTH SIDE OF HINKLEVILLE ROAD, WEST OF THE FLOODWALL", be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the zone classification change and the map amendment proposed in said resolution be, and the same are hereby declared to be in agreement with the comprehensive plan of the City of Paducah. SECTION 3. That the zone classification of the following property be, and it is hereby, changed as follows: Tract 1. From B-1 Neighborhood Business Zone to B-3 General Business Zone: Beginning at a point in the center line of U. S. Highway 60 (Hinkleville Road) at a point which is north 84 degrees 00 minutes 00 seconds east 772.60 feet from the intersection of the center line of U. S. Highway 60 with the center line of 32nd Street; thence north 5 degrees 30 minutes 00 seconds west a distance of 313.00 feet to a 5/8 inch iron rod set beside a concrete monument; thence north 84 degrees 00 minutes east a distance of 465 feet, more or less, to the west right- of-way line of the Paducah Floodwall; thence south 15 degrees 10 minutes 32 seconds west along and with the west right-of-way line of the Paducah Floodwall a distance of 345 feet, more or less, to the intersection of said right-of-way line with the center line of U. S. Highway 60; thence along and with the center line of U. S. Highway 60 south 84 degrees 00 minutes west a distance of 350 feet, more or less, to the point of beginning. 04 1 Tract 2. From R-4 Multiple Dwelling Zone to B-3 General Business Zone. Beginning at a point, a 5/8 inch rod set beside a concrete monument, same being the northwest corner of the lot of E. M. Bailey, of record in Deed Book 478, page 171, McCracken County Court Clerk's office; thence north 5 degrees 30 minutes west 1370.15 feet to an existing concrete monument in an old fence row; thence south 72 degrees 21 minutes east 94.05 feet to an existing stone; thence south 67 degrees 53 minutes 32 seconds east 1223.49 feet to a concrete monument in the westerly right- of-way line of the Paducah Floodwall (45 feet west of the center line thereof), thence south 15 degrees 10 minutes 32 seconds west a distance of 800 feet, more or less, to a point, the northeast corner of Tract 1 above; thence south 84 degrees 00 minutes west a distance of 890 feet, more or less, to the point of beginning. 38 SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 5. This ordinance shall be in full force and effect from and after its adoption.
