ORDINANCE NO. 70-11-401
AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING
COMMISSION RESPECTING THE REZONING OF PROPERTY ON THE SOUTH SIDE OF
PARK AVENUE, WEST OF 32ND STREET, AND AMENDING THE PADUCAH ZONING
ORDINANCE -1961 SO AS TO EFFECT SUCH REZONING
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF
PADUCAH, KENTUCKY:
SECTION 1. That a resolution adopted by the Paducah Planning
Commission on November 4, 1970, entitled "A RESOLUTION CONSTITUTING
THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED
REZONING OF PROPERTY ON THE SOUTH SIDE OF PARK AVENUE, WEST OF 32ND
STREET", be approved as the final report of said Commission respecting
the matters therein set forth.
SECTION 2. That the zone classification change and the map
amendment proposed in said resolution be, and the same are hereby
declared to be in agreement with the comprehensive plan of the City of
Paducah.
SECTION 3. That the zone classification of the following property
be, and it is hereby, changed from R-2 One -Family Residential Zone to
B-1 Neighborhood Business Zone, and from R-3 Two -Family Residential Zone
to B-1 Neighborhood Business Zone:
Tract No. 1 (From R-2 to B-1)
Beginning at a point in the center line of Hinkleville Road
which point lies 180 feet west of the intersection of the
center line of Hinkleville Road with the center line of 32nd
Street; thence in a southerly direction along and with the Old
City Limits line, which line is the current dividing line
between the R-3 and R-2 zones, a distance of 353 feet, more or
less, to a point in the south line of Mrs. Ruby Payne; thence
in a westerly direction along and with the south line of Mrs.
Ruby Payne, William M. Eison and Fred P. Ward a distance of
351.2 feet, more or less, to a point in the southwest corner
of Fred P. Ward; thence in a northerly direction along and with
the west line of Fred P. Ward a distance of 353.8 feet to a
point of intersection of the west line of Fred P. Ward, if
extended, with the center line of Hinkleville Road; thence
in an easterly direction along and with the center line of
Hinkleville Road a distance of 347 feet, more or less, to the
point of beginning.
Tract No. 2. (R-3 to B-1)
Beginning at the point of intersection of the center line of
Hinkleville Road with the center line of 32nd Street; thence
in a southerly direction along and with the center line of
32nd Street a distance of 353 feet, more or less, to the point
of intersection of the center line of 32nd Street with the south
line of William E. Harris, if extended; thence in a westerly
direction along and with the south line of William E. Harris

and Mrs. Ruby Payne a distance of 180 feet, more or less, to a
point in the Old City Limits line, same being the current
dividing line between the R-3 and R-2 zones; thence in a northerly
direction along and with the Old City Limits line a distance of
353 feet, more or less, to its point of intersection with the
center line of Hinkleville Road; thence in an easterly direction
along and with the center line of Hinklevi.11e Road a distance
of 180 feet, more or less, to the point of beginning.
SECTION 4. That if.any section, paragraph or provision of this
ordinance shall be found to be inoperative, ineffective or invalid for
any cause, the deficiency or invalidity of such section, paragraph or
provision shall not affect any other section, paragraph or provision
hereof, it being the purpose and intent of this ordinance to make each
and every section, paragraph and provision hereof separable from all
other sections, paragraphs and provisions.
SECTION 5. This ordinance shall be in full force and effect from
and after its adoption.
