ORDINANCE NO. 70-9-379
AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING
COMMISSION RESPECTING THE AMENDMENT OF SECTION 13, TITLE II, OF THE
PADUCAH ZONING ORDINANCE -1961, AND AMENDING SAID SECTION
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF
PADUCAH, KENTUCKY:
SECTION 1. That a Resolution adopted by the Paducah Planning
Commission on September 16, 1970, entitled "A RESOLUTION CONSTITUTING THE
FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED AMENDMENT
OF SECTION 13, TITLE II OF THE PADUCAH ZONING ORDINANCE -1961", shall be,
and it is hereby, approved as the final report of said Commission
respecting the matters therein set forth.
SECTION 2. That Section 13, Title II of the Paducah Zoning
Ordinance -1961, be, and the same is hereby, amended by adding thereto
a section to be known as Section 13A, to read as follows:
"SECTION 13 A, PLANNED HIGH-RISE APARTMENT DEVELOPMENT
The purpose of this section is to establish a procedure for the
development of high-rise apartments, which is otherwise prohibited
by the area dnd density requirements of the respective zoning districts.
(1) DEFINITION - A high-rise apartment shall be any
residential structure that is four (4) stories or more in
height and contains a minimum of sixteen (16) individual
dwelling units.
(2) REQUIREMENTS - It is the intent of this section
to handle each development of this nature as a separate
entity and to provide, through Commission approval, a
flexibility in the design of each. Consequently, the re-
quirements that would normally occur here are omitted and
will be set at the time of approval by the Commission
acting in the best interest of the public health, safety
and welfare. As a guideline to developers, the following
requirements are listed and will be those that the
Commission shall consider. Please note that the figures
indicated are strictly hypothetical and are not to be
considered final.
(a) YARD REQUIREMENTS
Front Yard 25 feet
Side yard:
Total of both 20 feet
Minimum 10 feet
Street side yard 25 feet
Rear yard 25 feet
(b) AREA REQUIREMENTS:
Area 12,000 sq. ft.
Width 100 feet
(c) MAXIMUM BUILDING HEIGHT:
There should be no maximum building height provided all
minimum yard requirements are increased three (3) feet
for each story above four (4) stories or sixty (60) feet.

(d) MAXIMUM FLOOR AREA RATIO
3.0 or 4.0
(e) MINIMUM USABLE OPEN SPACE PER UNIT
100 sq. ft. per 0 bedroom unit
200 sq. ft. per 1 bedroom unit
300 sq. ft. per 2 bedroom unit
(f) PARKING REQUIREMENTS
Parking requirements should be set according to the
intended use of the dwelling units and an acceptable
ratio established for each separate development.
(i.e. Elderly units ... 1 space per 4 units
(3) PROCURE
(a) Upon receipt of an application and a site plan of the
Proposed total development, the Planning Commission
shall hold a public hearing in the manner set out in
KRS Chapter 100. At this time the Commission shall
set the above stated requirements.
(b) If approval is granted at the public hearing, the
developer shall then submit engineering, architectural
and landscaping plans for review by the Building
Inspector, City Engineer and Planning Commission.
(c) Upon approval by the above, building permits and
certificates of occupancy may be issued, provided all
conditions have been met and all other requirements
completed."
SECTION 3. That if any section, paragraph or provision of this
ordinance shall be found to be inoperative, ineffective or invalid for
any cause, the deficiency or invalidity of such section, paragraph or
Provision shall not affect any other section, paragraph or provision
hereof, it being the purpose and intent of this ordinance to make each

SECTION This ordinance shall be in full force and effect from
and after its adoption.
