ORDINANCE NO. 70-5-328
AN ORDINANCE AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE
A PUBLIC UTILITY EASEMENT OVER AND THROUGH CERTAIN PROPERTY IN THE
FOREST HILLS AREA OF THE CITY OF PADUCAH
WHEREAS, an adjoining tract of land along the northeast
boundary of the Forest Hills property owned by the City of Paducah, is
in need of a public utility easement over and through the city property
for purposes of bringing water and other utilities to said land, and
WHEREAS, the Forest Hills Public Project Corporation has,
by resolution, recommended the approval of the granting of such an
easement,
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS
OF THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Mayor and City Clerk be, and they are
hereby, authorized and directed to execute a public utility easement
over and through a portion of the Forest Hills property owned by the
City of Paducah, Kentucky and managed and operated by the Forest Hills
Public Project Corporation, for the benefit of property located along
the northeast boundary of said Forest Hills property, which easement
is more particularly described as follows:
Beginning at a point on the southerly line of B. H.
Green 258.11 feet from the southwest corner of his
property and also 258.11 feet from the northeast
corner of the Forest Hills tract of land; thence with
an interior angle of 960 13' 20" and in a southerly
direction and along the line between Lots 14 and 15
of Block 1 of Forest Hills, 129.85 feet to the northerly
line of Glenwood Drive; thence with an interior angle
of 950 6' 23" to the tangent of the curve of Glenwood
Drive at Lot 14, and in an easterly direction and along
the curve of the northerly line of Glenwood Drive at
Lot 14, 5 feet; thence in a northerly direction, and
parallel to the first described line, to the northerly
line of Forest Hills and common corner to B. H. Green;
thence with the common line between Forest Hills and
B. H. Green and in a westerly direction 5 feet, more or
less, to the point of beginning. Reference to lots
herein are based upon sheet number 10 of a survey
of Forest Hills made by Elmer Y. Hollis, Registered
Engineer, in May, 1961, as filed in the office of
the City Engineer.
Being a portion of the same property conveyed to the
City of Paducah, Kentucky, by Paducah -McCracken County
Development Council, Inc. by deed dated November 22,
1968, of record in Deed Book 503, page 485, McCracken
County Court Clerk's office.

SECTION 2. This ordinance shall be in full force and effect
from and after its adoption.
