AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT,
ON BEHALF OF THE CITY OF PADUCAH, WITH THE COUNTY OF MCCRACKEN FOR
THE LEASE AND USE OF ONE HUNDRED ACRES OF LAND FOR LANDFILL PURPOSES
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF
PADUCAH, KENTUCKY:
SECTION 1. That the Mayor be, and she is hereby, authorized
and directed to execute a contract, for and on behalf of the City of
Paducah, Kentucky, with the County of McCracken, for the lease and use
of one hundred acres of land owned by McCracken County located adjacent
to Stuart Nelson Park and at the edge of the city limits, being part
of what is known as the Pace property, for a period of ten (10) years
according to the terms and conditions as hereinafter set forth.
A price of $25,008.30 shall be made for the lease and use of said
property for a term of ten (10 ) years from the date of execution of
the lease agreement. The City shall agree to maintain and operate
a landfill upon the said property for the use and benefit of all
residents of McCracken County, and to charge no more than a reasonable
fee for such service. Access to the property shall be from U. S.
Highway 60, and the County Government shall furnish all material
necessary to construct a road from the highway to the landfill site,
including an adequate structure for crossing Perkins Creek, and both
parties shall participate in the construction of said road with their
own personnel and equipment. The City shall thereafter be required to
maintain the road from the highway to the landfill site during the term
of the lease. The lease shall further provide that the County refuse
collectors may use the new landfill in the event that either or both of
the existing County landfill sites become closed, and the charges for
dumping by such commercial collectors shall be negotiated if and when
the need arises for their use of the City's landfill. The City shall
further agree to comply with all local, state and federal laws regarding
the operation of landfills and pollution of air and water, and the
City shall be responsible for conducting a solid waste disposal study
and pay all costs incident thereto.
SECTION 2. The City Treasurer is authorized to pay all sums
as were heretofore authorized in Section 1 above, and the sum of

$25,008.30 shall be payable from Account No. 3560, said payment to
be made to the County of McCracken in two (2) annual installments as
follows: $12,500.00 with the execution of the contract and $12,508.30
on or before June 30, 1973.
SECTION 3. An emergency is declared to exist and this ordinance
shall therefore be introduced and remain on file for one week for public
inspection in the completed form in which it shall be put upon its
final passage, and if adopted shall be in full force and effect
immediately thereafter.
