A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE A SPONSOR'S
ASSURANCE FOR A GRANT FOR THE DEVELOPMENT OR IMPROVEMENT OF THE BARKLEY
FIELD AIRPORT TO BE ATTACHED AS EXHIBIT B TO THE PROJECT APPLICATION
WHEREAS, the Paducah Airport Corporation is submitting a project
application for a Federal Grant to pay fifty percent of the cost
of acquiring 205.56 acres of land for increasing the area around
runway 4 at Barkley Field, and
WHEREAS, the total cost has been paid in the amount of $75,629.96,
and
WHEREAS, the Paducah Airport Corporation now seeks to obtain
reimbursement from the Federal Government in the amount of one-half
and from the State Government in the amount of one-fourth, and
WHEREAS, the City of Paducah and the County of McCracken are
co-sponsors, and the City of Paducah is required to provide certain
assurances for such grant,
NOW THEREFORE, BE IT RESOLVED, That the Mayor be, and she is
hereby, authorized and directed to execute Exhibit "B" entitled
"SPONSOR ASSURANCE TO ACCOMPANY PROJECT APPLICATION DATED
FOR A GRANT OF FUNDS FOR THE DEVELOPMENT OR IMPROVEMENT OF THE BARKLEY
FIELD AIRPORT", said exhibit being in words and figures as follows:
"Nondiscrimination in Federally -assisted programs of the Federal Aviation
Administration. In order to furnish the assurances required by the
Civil Rights Act of 1964 and by Part 15 of the Federal Aviation Re-
gulations, as amended, and as supplemented by Part 21 of the Regulations
of the Secretary of Transportation, the Paducah Airport Corporation
(Sponsor) hereby covenants and agrees with the United States (Government)
as follows:
The Sponsor in the operation and use of the Barkley Field Airport will
not on the grounds of race, color, or national origin discriminate
or permit discrimination against any person or group of persons in any
manner prohibited by said Act and Regulations.
"The Sponsor will also include, or require the inclusion, in every
agreement or concession pursuant to which any person, other than the
Sponsor, operates or has the right to operate any facility on the
Airport providing services to the public, the foregoing covenants as an
obligation assumed by that person, together with a provision granting
the Sponsor the right to take such action as the Government may direct
to enforce that covenant.
"Noncompliance with the above assurances shall constitute a material
breach, and in the event of such noncompliance the Government may take
appropriate action to enforce compliance, may terminate the Grant
Agreement to which this covenant relates, or seek judicial enforcement.
"The covenant shall become effective upon execution of a Grant Agreement
pursuant to the above identified project application and shall constitute
part of the Grant Agreement to which it relates and shall remain in full
force and effect so long as the airport covered by such agreement
continues to be used and operated as a public airport. The Sponsor

agrees to provide, if hereafter required by the Secretary, a supple-
mentary Assurance of Nondiscrimination in conformity with said Part 21.
"Any reference in said Act and Regulations to the 'Federal Aorport Act'
shall be deemed to mean the 'Airport and Airway Develop ment Act of 1970."'
SECTION 2. This resolution shall be in full force and effect from
and after its adoption.
