A RESOLUTION AUTHORIZING THE CORPORATION COUNSEL TO BRING A CIVIL
ACTION AGAINST THE PADUCAH POWER SYSTEM FOR COLLECTION OF IN -LIEU -OF TAXES
WHEREAS, pursuant to KRS 96.820 as amended in 1968, the City
of Paducah and the Paducah Independent School Board billed the Paducah
Power System for an in -lieu -of tax payment in the sum of $146,805.97
of which the City was to receive $62,166.29 and the School Board was
to receive $84,639.38, and
WHEREAS, the Paducah Power System has paid only $48,294.48
of which $21,978.52 is for the City of Paducah and $26,315.96 is for
the Paducah Independent School District, and
WHEREAS, the Paducah Power System is now delinquent in its full
payment and has indicated a refusal to pay any additional amount because
of a contractual relationship with the Tennessee Valley Authority,
NOW THEREFORE, BE IT RESOLVED -BY THE BOARD OF COMMISSIONERS OF THE
CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Corporation Counsel be, and he is hereby,
authorized to file a civil action on behalf of the City of Paducah, with
or without the participation of the Paducah Independent School District,
against the Paducah Power System for the purpose of recovering the balance
claimed due as an in -lieu -of tax payment from the Paducah Power System
to the City and School District.
SECTION 2. This resolution shall be in full force and effect
from and after its adoption.
