AN ORDINANCE AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE
AN INSTRUMENT RELEASING AND RELINQUISHING TO JIMMIE CURTIS HOOPER
AND WIFE, PATSY SUE HOOPER, ALL THE RIGHT OF THE CITY OF PADUCAH
IN AND TO CERTAIN FLOODWALL BORROW PIT RIGHTS, LESS AND EXCEPT AN
EASEMENT, IN EXCHANGE FOR SIMILAR RIGHTS IN AND TO CERTAIN LAND OWNED
BY THE SAID JIMMIE CURTIS HOOPER AND WIFE, PATSY SUE HOOPER
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF
PADUCAH, KENTUCKY:
SECTION 1. Subject to the terms and conditions set out in
Section 2 of this ordinance, the Mayor and City Clerk are hereby
authorized and directed to execute to Jimmie Curtis Hooper and wife,
Patsy Sue Hooper, an instrument releasing to them all of the rights
of the City of Paducah in and to floodwall borrow pit rights as to
the following property in McCracken County, Kentucky:
Beginning at a point which is at right angles to and a
distance of 40 feet riverside of Station 224 + 50 section "C"
of center line of the U. S. Engineer's survey of said center
line and being on the limits of the right of way previously
conveyed; thence along the same course in an easterly direction
80 feet to a point; thence at an interior angle of 103 degrees
15 minutes in a northerly direction 349 feet to a point; thence
at an interior angle of 166 degrees 45 minutes in a northerly
direction 310 feet to a point; thence at an interior angle
of 90 degrees and in a westerly direction 160 feet to a point
40 feet riverside and at right angles to Section 231 + 00
Section "C" of the levee survey; thence at an interior angle
of 90 degrees and in a southerly direction parallel to the
levee center line 650 feet to the point of beginning.
Such borrow pit rights were granted to the City of Paducah on
January 27, 1939 by Mrs. Virgie Woeltz et al, by an instrument of
record in Deed Book 200, page 196 in the McCracken County Court Clerk's
office.
There shall be excepted from the foregoing described tract and
there shall be reserved to the City therefrom, a strip of ground 20 feet
in width and 650 feet in length along the westerly line of the above
described tract as an easement for drainage purposes, whether as a
ditch or sewer, and the City shall retain all rights associated with
easements including the rights of maintenance, ingress and egress.
SECTION 2. That upon the execution and delivery by Jimmie Curtis
Hooper and wife, Patsy Sue Hooper, to the City an instrument granting

borrow pit rights for the construction and maintenance of the floodwall
and any roads in conndction therewith, with the right to remove any
and all dirt or material deemed by the City of Paducah to be necessary
in the construction, repair and maintenance of said floodwall, and the
right of the City, the United States Government, their contractors,

sub-contractors, agents, servants and employees to enter upon the
hereinafter described tract of land for the purposes aforesaid, in and
to the land described as follows:
Beginning at a point 120 feet riverside of Station 235 + 55
Section "C" of the center line of the U. S. Engineers levee
survey, said point being on the limits of the borrow pit ease-
ment previously conveyed; thence northerly and parallel. to the
levee center line 645 feet to a point at right angles to and
120 feet riverside of Station 242 + 00 section "C" of the levee
survey; thence in an easterly direction and at right angles to
the levee center line survey 140 feet to a point; thence in a
southerly direction a parallel to the levee center line survey
645 feet to a point; thence at an interior angle of 90 degrees
and in a westerly direction 140 feet to the point of beginning,
being part of the same land conveyed to Jimmie Curtis Hooper
and wife, Patsy Sue Hooper by Darrell Bell et al by deed dated
November 15, 1965 and of record in Deed Book 472, page 347 in
the McCracken County Court Clerk's office;
the Mayor and City Clerk are hereby authorized and directed to execute
to the said Jimmie Curtis Hooper and wife, Patsy Sue Hooper, the
instrument referred to and described in Section 1 hereof.
SECTION 3. This ordinance shall be in full force and effect
from and after its adoption.
