HomeMy WebLinkAboutOrdinances Book 16, Page 76, No Resolution Number76 / A RESOLUTION AUTHORIZING THE EXECUTION OF A CONTRACT BETWEEN THE CITY OF PADUCAH AND LYNN SHELBOURNE AND HOWARD S. LEWIS, PARTNERS DOING BUSINESS AS ANGEL OF MERCY AMBULANCE SERVICE, FOR EMERGENCY AMBULANCE SERVICE, AND PROVIDING COMPENSATION THEREFOP BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah enter into a contract with Lynne Shelbourne and Howard S. Lewis, Partners doing business as Angel of Mercy Ambulance Service, for the latter to provide emergency ambulance seri-ice'to the City of Paducah in accordance with the contract set forth hereinbelow, and that the City Manager be, and he is hereby, authorized'to execute, on behalf of the City of Paducah, an agreement or contract between the City of Paducah and said Lynne Shelbourne and Howard S. Lewis, Partners doing business as Angel of Mercy Ambulance Service, in words and figures as follows: "THIS CONTRACT made and entered into this day of March, 1967, by and between the CITY OF PADUCAH, KENTUCKY, herein- after referred to as City or as party of the first part, and LYNNE SHELBOURNE and HOWARD S. LEWIS, pEtners, doing business as ANGEL OF MERCY AMBULANCE SERVICE, 617 Jackson Street, Paducah, Kentucky, hereinafter referred to as party of the second part, W I T N E S S E T H WHEREAS, party of the second part operates a twenty-four hour ambulance service in the City of Paducah, and WHEREAS, from time to time party of the first part, by and through the PoliceDepartment, Fire Department and other agencies and representatives, is required to place emergency calls for ambulance service on account of automobile and other accidents, illness occurring on public streets, fires and other reasons, NOW THEREFORE it is agreed by and between the parties as follows, to -wit: 1. Party of the second part will maintain and provide to the City of Paducah, by and through its agencies aforementioned, twenty- four hour emergency service, and said party of the second part will provide services and equipment according to good standards and practices recognized by the American College of Surgeons Committee on Trauma. The party of the second part will respons with its own equip- ment from the closest location to the scene of the incident to all calls authorized and placed by the Police Department, Fire Department, any policeman or fireman of the City on duty, or other authorized representative of the City. 77 2. The party of the first part will compensate party of the second part for such twenty-four hour service according to party of Second part's regular schedule of charges which are used generally for its service to private customers subject to the following limitations and conditions: (a) Compensation shall not exceed $300.00 in any one calendar month. If calls for ambulance service in any one calendar month are so numerous that the regular schedule of charges would exceed $300.00 in such calendar month, the services will, nevertheless, be provided by party of the second part but such services will be provided without additional charge. (b) If the customer or patient for whom the call is placed is not an indigent person or a categorical aid recipient, then, in that event,party of the second.part will present no bill to the City for said service unless and until party of the second part has made an effort to collect for his services from such customer or patient. Effort to collect shall be deemed to have been made at_the expiration of ten days following two notices or.bills submitted by party.of the second part directly to the customer or patient, said two bills being spaced not less than thirty days apart. (c) If the customer or patient for whom the call is placed is an indigent person or a categorical aid recipient, then an effort by party of the second part to collect from such customer or patient shall not be a prerequisite to payment by the party of the first part for such service. In such cases however, party of the second part will make the effort to collect from such customer or patient by submitting two bills as stated in sub -paragraph (b) above. (d) In those cases where payment has been made by the City for services as provided hereunder, and where the customer or patient subsequently makes payment of his bill, then credit will be allowed by party of the second part on the next monthly bill which it submits to the City of Paducah. (e) Party of the second part will submit to party of the first part a statement on or before the 5th day of each month itemizing all services provided hereunder during the preceeding month. Said monthly statement will be on such form as shall be required by the City Manager of the City of Paducah, and said monthly stltement will provide the information required by the City Manager on such form. Party of the second part will maintain and furnish to the City Manager of the City 78 of Paducah such records and reports relating to services provided under this contract as shall be required by the City Manager. Party of the second part agrees to obtain and keep in full force and effect at all times covered by this agreement a Policy of liability insurance on each ambulance, which policy of insurance shall be properly endorsed so as to show the City of Paducah as a named insured and such policy shall have limits of not less than $50,000 - $100,000 for personal injury and $5,000 for property damage, and party of the second part will furnish a certificate of insurance or other evidence of coverage to the City. of Paducah. 4. Party of the second part agrees that it will pay its occupational license taxes and that it will otherwise abide by all applicable statutes and ordinances now in effect or which may hereafter 5. This contract is and shall be deemed to be a contract for one month beginning March 1, 1967 and continuing thereafter from month to month unless notice of termination is given in writing by either party not less than ten days before the end of any calendar month.
