ORDINANCE NO. 68-6-76
AN ORDINANCE DECLARING IT TO BE UNLAWFUL FOR AN OWNER, OCCUPANT
OR PERSON HAVING CONTROL OR MANAGEMENT OF ANY LAND WITHIN THE CITY OF
PADUCAH TO PERMIT A PUBLIC NUISANCE, HEALTH HAZARD OR SOURCE OF FILTH
TO DEVELOP THEREON THROUGH THE ACCUMULATION OF RUBBISH OR THE
EXCESSIVE GROWTH THEREON OF GRASS OR WEEDS, PROVIDING FOR ENFORCEMENT
OF THE LAW BY THE BUILDING INSPECTOR AND ESTABLISHING PROCEDURES FOR
PERFECTING LIENS AGAINST THE LANDS OF VIOLATORS
WHEREAS Section 381.770 of the Kentucky Revised Statutes has
been amended to provide a lien for cities of the second class
for clearing weeds and rubbish from property of landowners within
the City, and
WHEREAS the Board of Commissioners of the City of Paducah has
determined that the accumulation of rubbish or the excessive growth
on land of weeds or grass constitutes a public nuisance and a health
hazard,
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE
CITY OF PADUCAH, KENTUCKY:
SECTION 1. It shall be unlawful for the owner, occupant, or person
b having control or management of any land within the City of Paducah,
Kentucky, to permit a public nuisance, health hazard or source of
filth to develop thereon through the accumulation of rubbish or the
excessive growth thereon of grass or weeds.
SECTION 2. Whenever such a situation is discovered, the Building
Inspector of the City of Paducah shall give five (5) days written
notice to remedy such situation. The said notice shall be mailed to the
last known address of the owner of the said real property as it appears
on the current tax assessment roll. Upon the failure of the owner of
said property to comply, the Building Inspector, or other responsible
officer of his department designated by him, is authorized to send
employees or hired contractors upon said property to remedy the
situation.
SECTION 3. The City shall have a lien against the said property
for the reasonable value of labor and materials used in remedying such
situation. The affidavit of the Building Inspector shall constitute

prima facie evidence of the amount of the lien and the regularity
of the proceedings pursuant to this ordinance, and shall be recorded
in the office of the County Court Clerk of McCracken County, Kentucky.
The said lien shall be notice to all persons from the time of its
00 recording and shall bear interest at 6% per annum thereafter until paid.
SECTION 4. This ordinance, its prohibitions and its remedy shall
be in addition to any and all other ordinances heretofore enacted.
SECTION 5. This ordinance shall be in full force and effect
from and after its adoption.
