HomeMy WebLinkAboutOrdinances Book 16, Page 527, No Resolution Number527 % L/ A RESOLUTION AUTHORIZING THE CITY MANAGER TO ADVERTISE FOR BIDS FOR THE GRANTING OF A CONCESSION FOR FOOD, DRINK AND REFRESHMENT IN NOBLE PARK, INCLUDING THE SWIMMING POOL BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City Manager be, and he is hereby, authorized and directed to advertise for bids for the granting of a concession for food, drink and refreshment in Noble Park, including the swimming pool area, to be done under the following terms and conditions. There shall be a minimum of two food, drink and refreshment stands operated in Noble Park, one adjacent to the large parking lot on the west side of the lagoon, and the other within the bath house of the swimming pool area. The duration of the agreement shall be from the date of the contract or grant to and including December 31, 1969. The hours of operation shall be within the hours the park is officially open to the public as may be determined by the Board or by the Superintendent, but under no circumstances shall a concession stand be operated by an attendant prior to 12:30 P.M. on and Sunday. The successful bidder shall comply with all laws and ordinances, giving specific attention to litter, health and safety. The rental for the concession shall substitute for a business license, for this particular business, but the concessionaire shall withhold all applicable taxes from any employees. The City shall be insured by the concessionaire with an insurer acceptable to the City against personal injury damage claims in an amount equal to at least $300,000.00 and against property damage claims in an amount not less than $50,000.00. It shall be understood that any grant of a concession shall be null and void at the option of the Board upon violation of any terms or conditions of the agreement. Bids shall be made on the basis of the total amount of annual payment to the City, which payment shall be made in monthly installments during the months of May, June, July, August and September, payable in advance. The bidder will be required to describe generally the type service to be provided, including hot and cold items, and the method 528 of operation, and in determining the highest and best bid, the Board shall consider any and all significant factors. SECTION 2. The City Manager shall advertise for bids by a notice posted at the City Hall door and by inserting notice of the request in the Paducah Sun -Democrat to be published as required by law. All bids shall be sealed and no bid shall be received after the hour fixed in the notice for the opening of same. All bids so received by the City Manager shall be filed with the Board of Commissioners who may let a contract to the highest and best bidder, or all bids may be rejected, and the City shall not be obligated in any way until the execution of a contract pursuant to an ordinance authorizing same. SECTION 3. This resolution shall be in full force and effect from and after its adoption.
