HomeMy WebLinkAboutOrdinances Book 16, Page 525, No Resolution Number525 A RESOLUTION AUTHORIZING THE CITY MANAGER TO ADVERTISE FOR BIDS FOR THE GRANTING OF A CONCESSION FOR AMUSEMENT FACILITIES IN NOBLE PARK IN THE CITY OF PADUCAH, KENTUCKY BE TT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City Manager be, and he is hereby, authorized and directed to advertise for bids for the granting of a concession for amusement facilities in Noble Park in the City of Paducah, Kentucky, to be done under the following terms and conditions: Amusement facilities shall mean any device, game, sport, ride, recreation or other public amusement for which a fee or admission charge is collected, the meaning shall not inculde swimming, tennis, live animal rides and drink concessions. The duration of the agreement shall be from the date of the contract or grant to and including December 31,.1969. The minimum annual rental per facility will be $340.00 payable in five monthly installments of $68.00 each for the months of May, June, July, August and September. The hours of operation shall be within the hours the park is officially open to the public, and may be determined by the Superintendent or the Board of Commissioners, but under no circumstances shall an amusement facility be operated until after 12:30 P.M. on any Sunday. The successful bidder shall comply with all laws and ordinances, giving special attention to laws regulating and applying to litter, health and safety, and no gambling or gambling device shall be permitted. The rental for the concession shall substitute for a business license, but the concessionaire shall withhold all applicable taxes from the employees. The City shall be insured by the concessionaire with an insurer acceptable to the City against personal injury damage claims in an amount equal to at least $300,000.00, and against property damage claims in an amount of not less than $50,000.00. The facilities shall be located in an area to be designated by the Park Superintendent, subject to approval of the Board, but without further action, the facilities shall be located in the same area now used by Noble Park Funland, Inc. 526 The Board shall reserve the right to reject any and all bids and to accept or reject the use of any individual facility included in any bid that is otherwise acceptable, and after the execution of any contract no additional or substitute facilities shall be used without approval by the Superintendent. For any additional facilities the concessionaire shall pay the sum of $68.00 per month for operation during any portion of the months of May through September. For any reduction in facilities, rental shall be excluded for any full months remaining during said months. It shall be understood that any grant of a concession shall be null and void, at the option of the Board, upon the violation of any of the terms or conditions of the agreement. Bids shall be submitted on the basis of number, name or type of facility, and the charge to be made for each, and in determining the highest and best bid, consideration shall be given to any and all significant factors. SECTION 2. The City Manager shall advertise for bids by a notice posted at the City Hall door and by inserting notice of the request in the Sun -Democrat to be published as required by law. All bids shall be sealed and no bid shall be received after the hour fixed in the notice for the opening of same. All bids so received by the City Manager shall be filed with the Board of Commissioners who may let a contract to the highest and best bidder, or all bids may be rejected, and the City shall not be obligated in any way until the execution of a contract pursuant to an ordinance authorizing the same. SECTION 3. This resolution shall be in full force and effect from and after its adoption.
