HomeMy WebLinkAboutOrdinances Book 16, Page 476, Ordinance Number 68-2-20476 ORDINANCE 90. 68-2-20 AN ORDINANCE PROVIDING FOR THE REGULATION, LICENSING AND INOCULATION OF DOGS IN THE CITY OF PADUCAH, KENTUCKY; PROVIDING FOR THE EMPLOYMENT OF VETERINARIANS TO ISSUE LICENSES FOR THE KEEPING OF DOGS; PROHIBITING THE OWNERS OR KEEPERS OF DOGS FROM ALLOWING SUCH DOGS TO BE AT LARGE; PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING A SEPARABILITY CLAUSE BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. It shall be unlawful for any person, firm, company or corporation to own or keep a dog or dogs over the age of 6 months in the city of paducah, kentucky, without first obtaining a license for each dog. SECTION 2. The required license shall be good for the calendar year in which it is purchased, provided, however, that for a renewal of a license for a previously licensed dog there shall be a grace period to and including March 31 to provide a reasonable time for obtaining a new license. SECTION 3. The City Manager is hereby authorized to employ a sufficient number of veterinarians to inoculate dogs and to issue the license therefor, and the veterinarian shall receive for his services the sum of $2.25 for each dog inoculated by him. Each veterinarian so employed shall deposit with the City Treasurer the sum of $0.25 for each license tag obtained by him. Upon payment to his of a license fee of $2.25 it shall be the duty of the veterinarian to inoculate such dog and deliver to the owner the license tag issued by the City together with a certificate showing that such dog has been immunized against rabies. Any license tag or tags which are not used may be returned to the City Treasurer who shall refund to the veterinarian the sum of $0.25 for each unused tag. SECTION 4. Any owner or keeper of a dog or dogs who prefers �- to have the inoculation done by a veterinarian not employed by the City may, by furnishing the City Treasurer with a certificate of a licensed veterinarian that such dog or dogs have been immunized against radies and by paying a fee of $0.25 for each dog which has been inoculated, obtain a license therefor. 477 SECTION 5. The license tag so delivered to the owner or keeper of a dog shall be fastened to the collar of the dog and shall be worn continuously, and the failure to have such tag so attached shall subject the owner or keeper thereof to the penalties provided herein. SECTION 6. It shall be unlawful for the owner or keeper of any dog, either licensed or unlicensed, to allow such dog to be at large and not restrained by a leash or confined in an enclosure. SECTION 7. Any dog found at large shall be_subject to be seized and impounded by the City of Paducah and any such dog not claimed and whose release has not been procured within seven (7) days after its seizure, shall be subject to be disposed of in such manner as may be determined by the City Manager. On presentation of a release by the Police Court of the City of Paducah, any dog may be redeemed and released to its owner or keeper., within seven (7) days after being taken up and impounded upon payment of the following fees: A redemption fee of $5.00 shall be paid for the first time a dog is redeemed, but for each subsequent redemption of an individual dog the.redemption fee shall be $10.00.: The sum of $1.00 shall be due and payable for each day or part of a day a dog is kept in the pound, and a "day" shall mean a calendar day beginning one second after midnight. If any dog so'released has not been licensed, the sum of $2.75 shall be charged for inoculation and license. SECTION 8. Any person being the owner or keeper of a dog who fails to license such dog as required by this ordinance, or who permits such dog to be at large, shall, upon conviction be fined not less than $5.00 nor more than $25.00. SECTION.9. All license fees and fines shall be paid into the treasury of the City of Paducah to become a part of its general fund for public purposes, and all redemption fees shall be paid to the Humane Society to be applied against their cost of operation. SECTION 10. It shall be the duty of every police officer of the City of Paducah to obtain the name of the owner or keeper of any dog seen running at large and to obtain a summons for the owner's appearance in Police Court, and it shall further be the duty of every police officer to notify the Humane Society of the location of any dog or dogs running at large in the City of Paducah, 478 SECTION 11. All ordinances and parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION 12. If any section,part of a section, sentence, clause or phrase of this ordinance shall be held unconstitutional or invalid, the remaining provisions hereof shall nevertheless remain in full force and effect. SECTION 13. This ordinance shall be in full force and effect from and after April 1, 1968.
