ORDINANCE NO. 68-2-8
AN ORDINANCE ESTABLISHING A COMBINED AUXILIARY POLICE FORCE AND
CIVIL DEFENSE POLICE FORCE FOR THE CITY OF PADUCAH, KENTUCKY
WHEREAS the General Assembly of the Commonwealth of Kentucky has
"� authorized the legislative body of a city of the second class to establish
an auxiliary police force to perform special duties on terms deemed
proper by the said legislative body, such authorization being set out
in KRS 95.445, and
WHEREAS the General Assembly of the Commonwealth of Kentucky has
authorized legislative bodies of cities of the second class to establish
a civil defense police force as a part of its civil defense agency under
I the provisions of ERS 39.416, and
WHEREAS it is deemed advisable by the Board of Commissioners of the
City of Paducah, Kentucky, to establish a combined auxiliary police force
and civil defense police force,
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE
CITY OF PADUCAH, KENTUCKY:
SECTION 1. There is hereby established a combined auxiliary police
force and civil defense police force under and by virtue of the
authority granted by KRS 95.445 and KRS 39.416.
SECTION 2. PURPOSE
The purpose of said combined auxiliary police force and civil
defense police force is to provide one auxiliary police group to
perform all functions and duties permissible for or required by either
an auxiliary police force or a civil defense police force, and to
perform all duties set out by this ordinance not in conflict with
any applicable laws or statutes of the Commonwealth of Kentucky.
SECTION 3. MEMBERSHIP
The membership of said combined auxiliary police force and civil
defense police force shall not exceed fifty (50) members in number,
and shall include as officers of said force the following:
1 Chief
1 Assistant Chief
3 Captains
6 Lieutenants
Each member of said force shall be appointed by the Mayor in
writing and each and every officer thereof shall be so designated by

him, after prior approval by the Civil Defense Director and the Chief
of the Paducah Police Department.
SECTION 4. QUALIFICATIONS
Each member and officer of the combined auxiliary police force and
civil defense police force shall be a resident of the City of Paducah,
in good physical condition, able to read, write and understand the
English language, and no person shall be so appointed unless he is
a man of sobriety and integrity and is and has been an orderly, law
abiding citizen. Each member and officer shall be at least 21 years
of age.
Before entering upon the performance of duties hereunder, each
member and officer of the said combined police force shall execute a
bond in the sum of $1,000.00 with corporate surety to be approved by
the City Treasurer, conditioned that he will faithfully perform the
duties of his office, and the premiums for such bond shall be paid by
the City.
SECTION 5. DUTIES
Whenever the Mayor, City Manager or Chief of the Paducah Police
Department deems it necessary, members of the combined police force
shall assist, augment and supplement the functions of the regular police
department of the City in the control of traffic, crowds and any other
lawful activity, but no services or duties shall be performed by a
member or officer of the combined police force except upon direct order
of either the Mayor, City Manager or Chief of the Paducah Police
Department, When a state of emergency is declared by the Mayor,
members of the combined auxiliary police force and civil defense police
force shall become a part of the civil defense agency and shall be
subject to the orders of the Director of Civil Defense, the Mayor
or the Chief of the Paducah Police Department. When on active duty
during a state of emergency declared by the Mayor, each member and
officer of the combined police force shall have such duties and
responsibilities as are assigned to him by the Mayor, Civil Defense
Director or Chief of the Paducah Police Department and as provided
by state law.
SECTION 6. POWERS
When on active duty under an assignment, as provided for above,
each member and officer of the combined auxiliary police force and

civil defense police force shall have the powers of other peace officers
of the City of Paducah.
SECTION 7. COMPENSATION
No salary or wages or other compensation shall be paid by the City
to any member or officer of the combined police force and none of them
shall acquire any rights or benefits under the rules or laws of civil
service governing the regular members of the Paducah Police Department.
SECTION 8. REMOVAL
Any member or officer of the combined police force may be removed
as such at any time and without cause by the Mayor or by the joint
directive of the Civil Defense Director and Chief of the Paducah Police
Department.
SECTION 9. REPEAL OF PRIOR ORDINANCES
All ordinances and parts of ordinances in.conflict herewith are,
to the extent of such conflict, hereby repealed.
SECTION 10. SEPARABILITY CLAUSE
If any section, paragraph or provision of this ordinance shall be
found to be inoperative, ineffective or invalid for any cause, the
deficiency or invalidity of such section, paragraph or provision shall
not affect any other section, paragraph or provision hereof, it being
the purpose and intent of this ordinance to make each and every.section,
paragraph and provision hereof separable from all other sections,
paragraphs and provisions.
SECTION 11. EFFECTIVE DATE
This ordinance shall be in full force and effect from and after
its adoption.
