AN ORDINANCE AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A
DEED ON BEHALF OF THE CITY OF PADUCAH, KENTUCKY, CONVEYING LOT 9 in
BLOCK 2 OF MILLER, OWNE AND BRADSHAW'S OAK PARK ADDITION IN EXCHANGE FOR
PROPERTIES LOCATED ON OWEN STREET AND SEITZ STREET
WHEREAS, on May 8, 1967, Walker M. Turner & wife, Mary L.
Turner, delivered a deed executed by them to the City of Paducah con-
veying certain property on Owen Street and Seitz Street in exchange
for Lot 9 in Block 2 of Miller, Owen & Bradshaw's Oak Park Addition
owned by the City, and
WHEREAS, in order to consummate such exchange of property it is
necessary that the City execute its deed to said Lot 9 in Block 2 of
Miller, Owen & Bradshaw's Oak Park Addition to Walker M. Turner.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS
OF THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Mayor and City Clerk be and they are
hereby, authorized and directed to execute a deed of the City con-
veying to Walker M. Turner the following described tract of land
situated in said City:
Lot 9, Block 2 of Miller, Owen & Bradshaw's
Oak Park Addition, fronting 50 feet on the
east side of Owen Street and extending back
eastwardly 160 feet, more or less, to an alley.
Being the same property conveyed to the City of
Paducah, Kentucky, by Mrs. Rose Meyers by B. D.
Sills, Acting Treasurer of the City of Paducah,
by deed dated May 3, 1967 and of record in Deed
Book 486, page 568 in the McCracken County Court
Clerk's office.
Such deed executed by the Mayor and City Clerk shall reserve for
the benefit of the City of Paducah a permanent easement for the con-
struction and maintenance of a sewer line or sewer lines or drainage
ditch over and across the following described portion of the above
lot:
Beginning at a point on the southerly line of lot 9
60.0 feet east of the east property line of Owen Street;
thence with the southerly line of lot 9, easterly 100.0
feet to a 15 foot alley; thence northerly with said alley
50 feet to the northerly line of lot 9; thence westerly
with said northerly line of Lot 9, 5.0 feet; thence
southwesterly 107.33 feet to the point of beginning.

SECTION 2. The deed of conveyance authorized in Section 1
hereof shall contain no covenant of warranty and shall be subject
to any state of facts that might be shown by an accurate survey.
SECTION 3. This ordinance shall be in full force and effect
from and after its adoption.
