A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A
CONTRACT WITH PADUCAH TESTING SERVICE, INC., FOR THE PURPOSE OF OBTAINING
COMPRESSIVE STRENGTH TESTS OF CONCRETE CYLINDERS IN CONNECTION WITH THE
SEWER PROJECT AND PURSUANT TO THE TERMS OF THE AMENDED CONTRACT BETWEEN
THE CITY OF PADUCAH AND BURNS & MCDONNELL ENGCNEERING COMPAWY OF KANSAS
CITY, MISSOURI, PREVIOUSLY ADOPTED BY ORDINANCE ON DECEMBER 2, 1965
BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF
PADUCAH, KENTUCKY:
SECTION 1. That the City Manager be, and he is hereby, authorized
and directed to enter into, on behalf of the City of Paducah. a contract
with Paducah Testing Service, Inc., for the purpose of obtaining com-
pressive strength tests of concrete cylinders in connection with the
sewer project and pursuant to the terms of the amended contract between
the City of Paducah and Burns & McDonnell Engineering Company of Kansas
City, Missouri, in words and figures as follows:
"THIS AGREEMENT made and entered into on the day of
1967, by and between the CITY OF PADUCAH, a Municipal Corporation
operating and existing under the laws of the State of Kentucky. as a
city of the second class, hereinafter referred to as "City", and
PADUCAH TESTING SERVICE, INC. of Paducah, Kentucky, hereinafter
referred to as "Contractor",
W I T N E S S E T H:
THAT WHEREAS, the City has heretofore on December 6, 1965,
entered into a contract with Burns & McDonnell Engineering Company
of Kansas City, Missouri, for engineering consulting and supervision
of various sewer projects within the City, and
WHEREAS, it is essential to the project that services for
testing concrete cylinders be provided, which service was agreed to
in Section 2 of said contract,
NOW THEREFORE, for and in consideration of the mutual agreements
herein contained the parties hereto agree as follows:
Article I
STATEMENT OF THE WORK
The Contractor shall furnish all equipment, material and labor
as required to obtain compressive strength tests of concrete
cylinders, and shall perform all such tests as are required by the
resident engineer of said Burns & McDonnell Engineering Company/

The Contractor shall furnish, and deliver to the job site, cylinder
molds of the size and type prescribed by ASTM C31. Each mold shall
have a tag which can be attached to the cylinder for identification.
Concrete shall be collected at the job site no sooner than
twenty-four (24) hours and no later than forty-eight (48) hours after
the samples are made, and delivered to the point of eventual testing.
This service shall include storing and curing the cylinders under moist
conditions at approximately 70 degrees until they are tested. Concrete
cylinders which are stored and cured but which are not to be tested,
as directed by the resident engineer or authorized respresentative of
the City, shall be discarded.
Concrete cylinders selected for testing shall be tested to
determine the compressive strength in pounds per square inch with the
equipment and by the methods prescribed .in ASTM C39. Cylinders shall
be kept to insure parallel end surfaces in accordance with ASTM C31.
Reports of each cylinder test to include the information out-'
lined in Section 6 of ASTM C39 shall be submitted as follows:
1. City of Paducah, Kentucky - 1 copy .
2. Burns & McDonnell, Kansas City office - 1 copy
3. Burns & McDonnell Resident Engineer - 1 copy
4. Contractor - 2 copies
5. Concrete supplier - 1 copy
Article II
TIME AND DURATION
This Agreement shall be in full force and effect from its
date until the completion of the sewer project and the conclusiob if
the City's said contract with Burns & McDonnell Engineering Company.
Any work heretofore performed by the Contractor on behalf of the
Resident Engineer and approved by same shall be included herein and
compensated at the rates hereinafter set forth.
Article III
PAYMENT
The City agrees to pay the Contractor for her services as follows:
1. Payment will be at the rate of $0.35 each for cylinder
molds furnished and delivered in accordance with Article 1 above.
2. Payment will be at the rate of $0.50 each for concrete cylinders
collected, transported, stored and cured in accordance with
Article 1 above.

3. Payment will be at the rate of $2.60 each for concrete
cylinders prepared, tested and reported in accordance with
Article I above.
All work performed by the Contractor shall be at the direction
and under the supervision of the Resident Engineer, and all statements
berequesting payment for services shall first be submitted to the said
engineer for approval, and approved statements will then be presented
to the City for payment.
Article IV
CANCELLATION
This Agreement may be cancelled by either party upon furnishing
to the other party a notice in writing at least two (2) weeks before
the proposed termination.
It is mutually agreed by and between the parties that the City
may rescind and annul this agreement at any time and without said
notice, if the Contractor shall fail to perform his services in a
proper and diligent manner, and it is definitely understood and
agreed that the resident engineer will be the sold judge as to the
efficiency with which the Contractor is carrying on his part of the
work, and the City reserves the right to, at any time, terminate
this agreement, without prejudice, and without the right to
recovery of damages by the Contractor, upon receiving a report
about the contractor from the resident engineer of unsatisfactory
and/or inefficient work together with a recommendation for termi-
nation.
IN WITNESS WHEREOF, the parties have hereunto set their hands
in duplicate on this the day first above written.

SECTION 2. This Resolution shall be in full force and effect from
