A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT
WITH EDWARD T. HANNAN & ASSOCIATES, INC. CONSULTING ENGINEERS OF
PADUCAH, KENTUCKY, FOR OBTAINING IN-PLACE DENSITY AND COMPACTION
OF SOIL TESTS

SECTION 1. That the City Manager be, and he is hereby, authorized
and directed to enter into, on behalf of the City of Paducah, Kentucky, a
contact with Edward T. Hannan & Associates, Inc., Consulting Engineers of
Paducah, Kentucky, for obtaining in-place density and compaction of soil
tests, in words and figures as follows:
"THIS AGREEMENT made and entered into this day of
1967, by and between the CITY OF PADUCAH, a Municipal Corporation
operating and existing under the laws of the State of Kentucky, as a
city of the second class, hereinafter referred to as "City", and
EDWARD T. HANNAN & ASSOCIATES, INC. Consulting Engineers of Paducah,
Kentucky, hereinafter referred to as "Contractor".
W I T N E S S E T H
THAT WHEREAS, the City has heretofore on December 6, 1965
entered into a contract with Burns & McDonnell Engineering Company
of Kansas City, Missouri, for engineering consulting and supervision
of various sewer projects within the City, and
WHEREAS, it is essential to the project that services for
in-place density and 'compaction of soil tests be provided, which
service was agreed to in Section 2 of said contract,
NOW THEREFORE, for and in consideration of the mutual agreements
herein contained the parties hereto agree as follows:
Article I
SCOPE OF THE WORK
The Contractor shall furnish all equipment, material and labor
as is necessary to obtain in-place density and compaction of soil test.
The Contractor shall conduct proctor tests in accordance with
AASHO T99. The work shall include acquisition of samples, laboratory
testing, and reporting of results. These tests results shall be
used as a basis for compaction determination when compared to in-place
density, and as a basis for determining optimum moisture content.

The Contractor shall determine density of compaction material in
accordance with AASHO T147, and the work shall include acquisition
of field samples, laboratory testings, computation; and reporting of
results.
The Contractor shall submit reports of each test as follows:
1. City of Paducah, Kentucky - 1 copy
2. Burns & McDonnell Kansas City office - 1 copy
3. Burns & McDonnell Resident Engineer - 1 copy
4. Contractor - 2 copies
ARTICLE II
TIME AND DURATION
This Agreement shall be in full force and effect from its date
until the completion of the sewer project and the conclusion of the
City's said contract with Burns & McDonnell Engineering Company.
Any work heretofore performed by the Contractor on behalf of
the Resident Engineer and approved by same shall be included herein
and compensated at the rates hereinafter set forth.
Article III
PAYMENT
The City agrees to pay the Contractor for his services as follows:
1. Payment will be at the rate of $35.00 each for proctor tests
which shall include all work defined in Article I above.
2. Payment will be at the rate of $10.00 each for in-place density
tests which shall include all work defined in Article I above.
All work performed by the Contractor shall be at the direction
and under the supervision of the Resident Engineer, and all statements
requesting payment for services shall first be submitted to the said
engineer for approval, and approved state ments will then be presented
to the City for payment.
Article IV
CANCELLATION
This Agreement may be cancelled by either party upon furnishing
to the other party a notice in writing at least two (2) weeks before
the proposed termination.
It is mutually agreed by and between the parties that the City
may rescind and annul this agreement at any time and without said notice,
of the Contractor shall fail to perform his services in a proper and

diligent manner, and it is definitely understood and agreed that the
resident engineer will be the sole judge as to the efficiency with which
the Contractor is carrying on his part of the work, and the City reserves
the right to, at any time, terminate this agreement, without prejudice,
and without the right of recovery of damages by the Contractor, upon
receiving a report about the Contractor from the Resident Engineer of
unsatisfactory and/or inefficient work together with a recommendation
for termination.
IN WITNESS WHEREOF, the parties have hereunto set their hands
in duplicate on this the day first above written.
