AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING
COMMISSION RESPECTING THE REZONING OF PROPERTY SOUTH OF HINKLEVILLE
ROAD AND WEST OF 32ND STREET, AND AMENDING THE PADUCAH ZONING ORDINANCE -
1961 SO AS TO EFFECT SUCH REZONING
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH,
KENTUCKY:
SECTION 1. That a resolution adopted by the Paducah Planning
Commission on October 15, 1969, entitled "A RESOLUTION CONSTITUTING THE
FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED REZONING
OF PROPERTY SOUTH OF HINKLEVILLE ROAD AND WEST OF 32ND STREET", be approved
as the final report of said Commission respecting the matters therein set
forth.
SECTION 2. That the zone classification change and the map
amendment proposed in said resolution be, and the same are hereby declared
to be in agreement with the comprehensive plan of the City of Paducah.
SECTION 3. That the zone classification of the following property
be, and it is hereby, changed from M-1 General Industrial Zone to B-3
General Business Zone:
Beginning at a point in the existing dividing line between
the B-3 Zone and the M-1 Zone lying south of and running
parallel with the Hinkleville Road at the point of inter-
section of said dividing line with the east property line
of Albert and Thelma Dale; thence in a southerly direction
along and with the east property line of Albert and Thelma
Dale a distance of 375 feet to a point, the southeast corner
of said Dale property, thence with an interior angle of 89
degrees 25 minutes in a westerly direction a distance of 165.30
feet to the southwest corner of Albert and Thelma Dale; thence
with an interior angle of 90 degrees 05 minutes and in a
northerly direction a distance of 375 feet to a point in said
dividing line between the B-3 zone and M-1 zone; thence
in an easterly direction along and with the said zone dividing
line a distance of 165.30 feet to the point of beginning.
SECTION 4. That if any section, paragraph or provision of this
ordinance shall be found to be inoperative, ineffective or invalid for
any cause, the deficiency or invalidity of such section, paragraph or
provision shall not affect any other section, paragraph or provision
hereof, it being the purpose and intent of this ordinance to make each
and every section, paragraph and provision hereof separable from all
other sections, paragraphs and provisions.
