A RESOLUTION RECITING THE NEED FOR ACQUIRING CERTAIN LAND
OWNED BY ROY J. PETTER AND HIS WIFE, HELEN E. PETTER, TO BE USED
FOR A STREET, AND PROVIDING AND AUTHORIZING THE CONDEMNATION OF SAME
WHEREAS certain land owned by Roy J. Petter and his wife, Helen
E. Petter, in Paducah, Kentucky, is needed for the construction of a
street, and
WHEREAS the owners have refused all offers or attempts for
negotiation heretofore made by the City, and
WHEREAS the said owners have demanded what, in the consideration
of the Board, is an excessive amount for the property sought to be
taken, and
WHEREAS after negotiating for the purchase of same it is not
possible to consummate such purchase at a value satisfactory to the
City of Paducah, Kentucky, and
WHEREAS it will be necessary to institute condemnation proceedings
in McCracken Circuit Court to acquire title to same,
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF
THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Corporation Counsel, be, and he is hereby
authorized and directed to institute condemnation proceedings in
McCracken Circuit Court against Tor J. Petter and his wife, Helen E.
Petter, and all parties in interest, to acquire title for the opening.
extension and widening of a public way, namely, a street connecting the
intersection of Broad and Bridge Streets with South 9th Street in the
City of Paducah, Kentucky.
SECTION 2. That the property to be taken is more Darticularly
described as follows:
PERMANENT FEE FOR RIGHT-OF-WAY
Beginning at a point on the north property line of Broad
Street 524 feet west of the northwest corner of the
intersection of 6th Street and Broad Street; thence in a
northwesterly direction along the grantor's southwesterly
property line 709.5 feet to the line dividing the property
of the grantor and W. W. Hughes; thence with said dividing
line in a northeasterly direction 133 feet more or less to
the grantor's northeasterly property line; thence in a
southeasterly direction along the grantor's northeasterly
property lin e a distance of 230 feet more or less; thence
at right angles in a southwesterly direction 71 feet; thence
at right angles and in a southeasterly direction, a distance
of 470 feet to the northerly property line of Broad Street;
thence with the northerly property line of Broad Street in
a southwesterly direction a distance of 62 feet to the point
of beginning.

EASTMENT FOR BANK SLOPING
A strip of ground 15 feet in width lying adjacent to the
east side of the above described property, said strip begins
320 feet north of Broad Street and extends north 150 feet.

SECTION 3. This resolution shall be in full force and effect from
and after its adoption.
