HomeMy WebLinkAboutOrdinances Book 15, Page 86, No Ordinance Number86/ V � AN ORDINANCE EXTENDING THE BOUNDARY OF THE CITY OF PADUCAH, KENTUCKY, BY ANNEXING CERTAIN PROPERTY LYING ADJACENT TO THE E CORPORATE LIMITS OF SAID CITY, AND DEFINING ACCURATELY THE BOUNDARY OF SAID PROPERTY TO BE INCLUDED WITHIN SAID CORPORATE LIMITS WHEREAS under an ordinance adopted February 24, 1959, the City of Paducah, Kentucky, by and through its Board of Commissioners, proposed to extend the boundary of the city by annexing certain property lying adjacent to the west corporate limits of said city, and WHEREAS said ordinance proposing such annexation and declaring the desirability and necessity of same was published in ten (10) issues of the Sun -Democrat, a newspaper published and distributed in Paducah, Kentucky, during the period of thirty (30) days immediately after the enactment of said ordinance, and WHEREAS after the adoption of said ordinance and before the expiration of such thirty (30) day period, James Robards, a resident and a freeholder in said territory, and others filed a Complaint of remonstrance in McCracken Circuit Court opposing such proposed annexation, and WHEREAS on September 5, 1961, and after the trial of the action, the Judge of the McCracken Circuit Court rendered a judgment ordering the annexation of said property proposed to be annexed, which property is hereinafter particularly and accurately described, and WHEREAS thereafter and within the time prescribed by law the said James Robards and the other plaintiffs in said action appealed the decision rendered therein to the Court of Appeals of Kentucky, and WHEREAS on May 10, 1963 said Judgment of McCracken Circuit Court was affirmed by the Court of Appeals of Kentucky, and WHEREAS thereafter and within the time prescribed by law, the said James Robards and others filed with the Court of Appeals of Kentucky a petition for rehearing, and WHEREAS on June 21, 1963 the Court of Appeals of Kentucky overruled such petition for rehearing, and issued its mandate therein to the Clerk of the McCracken Circuit Court, and WHEREAS said mandate has been recorded by the Clerk of McCracken Circuit Court, and WHEREAS the Clerk of the McCracken Circuit Court has certified said Judgment rendered on September 5, 1961 to the Board of Commissioners of the City of Paducah, Kentucky. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: 87 SECTION 1. That the hereinafter described property be annexed to the City of Paducah, Kentucky, the same being more particularly and accurately described as follows: Beginning at a point in the present city limits line said point being the south east corner of the intersection of Fortieth Street or Country Club Lane and South Central Avenue; thence in a northerly direction and with the easterly property line of Fortieth Street or Country Club Lane 1770.$' more or less to the south property line of the Pines Road; thence in a westerly direction and with the south property line of the Pines Road 88.3' more or less to a point where the southerly line of the Camilla Hougland property if extended would intersect the south property line of the Pines Road, said Houghland property being acquired by deed recorded in Deed Book 372, page 273, McCracken County Court Clerk's office; thence N. 680-021- 17" west, crossing the Pines Road and with the southerly line of the Camilla Hougland property and continuing with the southerly line of the Country Club Terrace Sub- division, as recorded in Plat Book "F", page 40, McCracken County Court -Clerk's Office, a distance of 1401.8' more or less to a stone in the southerly property line of Phillips Avenue; thence north 420-29'-24" east and along the southerly property line of Phillips Avenue 1385.76' to a stone; -thence north 420-59' east and continuing along the southerly property line of Phillips Avenue 115.0' to the south west corner of the intersection of Phillips Avenue and Belleview Drive; thence at right angles and in a northerly direction 50' to the northerly property line of Phillips Avenue$ thence north 420-59' east and with the northerly property line of Phillips Avenue 115.3' more or less to a point 160' from the westerly property line of Lillian Avenue; thence in a northerly direction 160' from and parallel with Lillian Avenue a distance of 528' to the northerly property line of Minnich Avenue; thence in an easterly direction and with the northerly property line of Minnich Avenue and with said line extended 1028.0' more or less to the north east corner of Lot 6, Block B, Annida Jennings Rose Subdivision as recorded in Plat Book A, Page 112, McCracken County Court Clerk's Office; thence in an easterly direction approximately 762' to a point where the present city limits line intersects the northerly property line of Minnich Avenue as established by.plat of River Oaks Subdivision recorded in Plat Book D, page 88, McCracken County Court Clerk's Office; thence in a southerly and westerly direction with the present city limits line to the point of beginning. SECTION 2.
