AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH-McCRACKEN
COUNTY PLANNING COMMISSION RESPECTING THE REZONING (FOR PURPOSES OF
CORRECTION) OF PROPERTY ON THE NORTH SIDE OF HINKLEVILLE ROAD (PARK
AVENUE) WEST OF THE FLOODWALL, AND AMENDING THE PADUCAH ZONING ORDINANCE -
1961 SO AS TO EFFECT SUCH REZONING
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF
PADUCAH, KENTUCKY:
SECTION 1. That a resolution adopted by the Paducah -McCracken
County Planning Commission on June 5, 1963, entitled "A RESOLUTION
CONSTITUTING THE FINAL REPORT OF THE PADUCAH-McCRACKEN COUNTY PLANNING
COMMISSION ON THE PROPOSED REZONING OF PROPERTY ON THE NORTH SIDE OF
ROAD
HINKLEVILLE/(PARK AVENUE), WEST OF THE FLOODWALL, SO AS TO ACCOMPLISH
A CORRECTION OF THE ERRONEOUS ZONE CLASSIFICATION ASSIGNED TO SAID PROPERTY
UPON THE OCCASION OF THE AMENDMENT OF THE PADUCAH ZONING ORDINANCE -1961
ON JUNE 8, 1961", be approved as the final report of said Commission
respecting the matters therein set forth
-SECTION 2. oThat pursuant to said Resolution, and for the purpose
recited in the title thereof, the zone classification of the property -
described below shall be, and it is hereby, changed from R-3 Two -Family
Residential to B-3 General Business:
Beginning at a point in the center line of Hinkleville Road
(Park Avenue) west of Levin Avenue marking the intersection of
that line with the west line of the Floodwall Right-of-way,
extended; thence north with the west line of the Floodwall
Right-of-way 1142.71 feet, more -or less, to the city limits;
thence west with the city limits 1335.66 feet; thence south
with the city limits and a straight line extension thereof
1724.25 feet more or less to the center line of Hinkleville
Road (Park Avenue); thence east with the centerline of
Hinkleville Road (Park Avenue) 765 feet more or less to the
beginning.
SECTION 3. That the Paducah Zoning Ordinance -1961 and the maps
referred to in Section 14 thereof shall be, and they are hereby, amended
to the extent and in the respects necessary to effect.and designate the
change provided for in Section 2 hereof.
SECTION 4. That if any section, paragraph or provision of this
ordinance shall be found to be.inoperative-., ineffective or invalid for
any cause, the deficiency or invalidity of such section, paragraph or
provision shall not affect any other section, paragraph or provision
hereof, it being the purpose and intent of this ordinance to make each
and every section, paragraph and provision hereof separable from all
other sections, paragraphs and provisions.
SECTION 5. That this ordinance shall be in full force and
effect from and after its adoption.
