HomeMy WebLinkAboutOrdinances Book 15, Page 293, No Ordinance NumberAN ORDINANCE ESTABLISHING AN AUXILIARY POLICE FORCE TO PERFORM SPECIAL DUTIES WITHIN THE CORPORATE LIMITS OF THE CITY OF PADUCAH, KENTUCKY WHEREAS the General Assembly of the Commonwealth of Kentucky, at its regular session held in 1960, authorized the legislative body of a city of the second class to establish an auxiliary police force to perform special duties on terms deemed proper by said legislative body, such authorization being set out in Chapter 210 of the 1960 Acts of said General Assembly and now known as KRS 95.445, and WHEREAS it is deemed advisable by the Board of Commissioners of the City of Paducah, Kentucky, to establish such an auxiliary police force. NOVI THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1_. Establishment_ There is hereby established an auxiliary police force under and by virtue of the authority granted by Chapter 210 of the Acts of the 1960 General Assembly of the Common- wealth of Kentucky, now known as KRS 95.445. SECTION 2. Purpose. The purpose of said auxiliary police force is to perform any and all duties set out by this ordinance not in conflict with any applicable laws or statutes of the Common- wealth of Kentucky. SECTIONS Membership_ The membership of said auxiliary police force shall not exceed fifty (50) members in number, and shall include as officers of said force the following: 1 Chief 1 Assistant Chief 3 Captains 6 Lieutenants Each.member of said force shall be appointed by the City Manager in writing and each and every officer thereof shall be so designated by him. SECTION 4. Qualifications_ Each member and officer of the auxiliary police force shall be a resident of the City of Paducah in good physical condition, able to read, write and understand the English language, and no person shall be so appointed unless he is a man of sobriety and integrity and is and has been an orderly, law abiding citizen. Each member and officer shall be at least twenty-one (21) years of age. x 293 294 Before entering upon the performance of duties hereunder, each member and officer of the said auxiliary police force shall execute a bond in the sum of $1000.00 with corporate surety to be approved by the City Treasurer, conditioned that he will faithfully perform the duties of his office. The premiums for such bonds shall be paid by the City. SECTION 5. Duties.. The duties of said auxiliary police force shall be to assist, augment and supplement the functions of the regular police department of the City in the control of traffic, crowds and any other lawful activity deemed necessary by either the City Manager or the Regular Chief of Police. No services or duties shall be performed by a member or officer of the auxiliary police force except upon direct order of either the City Manager or the Regular Chief of Police. SECTION 6,_ Powers. When on active duty under the assignment of the City Manager or the Regular Chief of Police, each member and officer of the auxiliary police force shall have the powers of other Peace Officers of the City. SECTION 7. Compensation. No salary or wages or other com- pensation shall be paid by the City to any member or officer of the auxiliary police force and none of them shall acquire any rights or benefits under the rules or laws of civil service governing the regular members of the Police Department of the City. SECTION 8, Removal. Any member or officer of the auxiliary police force may be removed as such at any time by the City Manager without cause. SECTION 9. Repeal of Prior_Ordinances. All ordinances and parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION 10. Separability Clause. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 11. Effective date.
