OF CERTAIN TYPES OF MERCHANDISE TO BE UNLAWFUL; NAMING SUCH PROSCRIBED
TYPES OF MERCHANDISE, AND PROVIDING PENALTIES FOR VIOLATION THEREOF
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF
PADUCAH, KENTUCKY:
SECTION 1. It shall be unlawful for any person, firm or
corporation to sell or offer for sale on Sunday, within the corporate
limits of the City of Paducah, Kentucky, any clothing; wearing apparel;
clothing accessories; furniture; houseware; piece goods; textiles;
home, business or office furniture, fixtures or appliances; hardware;
tools; wheel goods: building material; jewelry; silverware; watches;
clocks; luggage; musical instruments; recordings; and toys, excluding
novelties and souvenirs.
SECTION 2. Any person, firm or corporation violating any pro-
vision of this ordinance shall, upon conviction, be fined not less than
$10.00 nor more than 4,200.00 for each offense; and a separate offense
shall be deemed committed each time a sale or offer to sell is made in
violation of Section. 1 hereof.
SECTION 3. Prosecution for violating any provision of this
ordinance shall be commenced within thirty days after the offense is
committed and not after.
SECTION L. The provisions of this ordinance are separable. If
any provision, section, paragraph, sentence or part thereof, or the
application thereof to any type of merchandise described in Section 1
hereof shall he held unconstitutional or invalid, such decision shall
not affect or impair the remainder of the ordinance, it being the -
legislative intent to ordain and enact each provision, section, paragraph,
sentence and part thereof separately and independent of each other.
SECTION 5. This ordinance shall be in full force and effect from
and after the 15th day of October, 1963.
