AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK OF
THE CITY OF PADUCAH, KENTUCKY, TO EXECUTE A QUIT CLAIM DEED TO THE COTSION-
112ALTH OF KENTUCKY, FOR THE USE AND BENEFIT OF THE DEPARTMENT OF HIGHWAYS,
ALL THE INTEREST OF THE CITY IN CERTAIN PROPERTY NEEDED FOR THE IMPROVE -
RENT OF A PUBLIC HIGHWAY WITHIN THE CITY
WHEREAS, the Department of Highways or the Commonwealth of Kentucky
has reconstructed and improved and is planning .for further reconstruction
and improvement of a public road and sidewalk in the City of Paducah,
Kentucky, known as US 45 and known as Kentucky Project No. 73-112-12L, and
WHEREAS, said Department has requested that the City convey
certain land needed in the improvement of said public road and for the
construction of sidewalk with no monetary consideration, but in con-
sideration of benefits to be derived by the City from such construction.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COArMISSIONERS OF
THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Mayor and City Clerk of the City of Paducah,
Kentucky, be, and they are hereby, authorized, on behalf of said City,
to convey by Quit Claim Deed to Commonwealth of Kentucky, for the use
and benefit of the Department of Highways, without monetary consideration
but in consideration of benefits to be derived by the City from the
construction of a public road therein, all its interest in and to the
following described land:
Parcel No. 5-A
All that part of said tract or tracts which lie between
the existing 36 foot right of away and a line run 38 feet left
or east of and parallel to the centerline of the proposed public
road between approximate station 5+50 and the south property
line at approximate station 6+25.
It is understood between the parties hereto and made a
covenant herein that the above described property is conveyed
in fee simple and not merely for right of way purposes.
Also the following parcel of land lying immediately adjacent
to the above described parcel on the side, to the width, and
between the stations shown below.

It is the specific intention of the grantors herein to
convey a temporary easement to the property described above
and designated as parcel (a) for the purpose of use during
construction, and said easement terminates and reverts upon
completion of same.
SECTION 2. The quit claim deed of conveyance authorized in Section
hereof shall contain no covenants as to title except to those of quit claim.
SECTION 3. This ordinance shall be in full force and effect
from and after its adoption.
