HomeMy WebLinkAboutOrdinances Book 15, Page 1038, No Ordinance Number103 v AN ORDINANCE ESTABLISHING THE CITY OF PADUCAH, KENTUCKY AS AN INDEPENDENT CITY PLANNING UNIT WITHIN THE PURVIEW OF CHAPTER 100 OF THE KED.TUCKY'REVISED STATUTES, ESTABLISHIN0, A PLANNING COMMISSION AND A BOARD OF ADJUSTMENT, AND OTHER RELATED MATTERS, AND CONSTITUTING SUCH ORDINANCE A "REGULATION" WITHIN THE PURVIEW OF SAID STATUTES WHEREAS by Resolution adopted on June 16, 196(. by this Board, the City of Paducah, Kentucky interrogated the Count- of McCracken, Kentucky respecting- the formation of a Joint Planning Unit within the purview of Chapter 100 of Kentucky Revised Statutes, and WHEREAS such Resolution was certified by the Citv Clerk to the County Judpe of McCracken County and to the Fiscal Court of said County on June 1C-., 1066, in conformity with the provisions thereof, and YWHEREAS the County of McCracken Kentucky has never responded to such interrogation, and WHEREAS the sixty day period prescribed ~y KRS 100.117 (1) has lona since expired, and it is now apparant that the County of McCracken, Kentuckv does not desire to loin with the City of Paducah, Kentuckv in the formation of a Joint.Planning Unit, and it must therefore be assumed that the answer of said County is in the negative, 111071 THEREFORE, BE IT'OP_DAIFED BY THE BOARD OF `COPD-4ISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah, Kentucky shall constitute, and shall be rewarded as, an independent Planning- Unit within the purview of Chapter 100 of the Kentucky Revised Statutes, the boundaries and the area of iurisdicti.on of which shall be the boundaries and area of the said City,'as from time'to time existin:r. However, nothing herein contained shall 1-e deemed to affect or to restrict the right or power of t're Commission to exercise extra -territorial iurisdiction, as may 're permitted ty any applicable law. S ECTION 2. That the establishment of the said independent Planning Unit shall be with the followinc- purposes and objectives in mind, which shall not be considered exclusive, and which are merely demonstrative of the intent of this Board: a. To secure the maximum economical, physical and social wel.far for the City of Paducah, and, to the extent that may be properly applicable from time to time, the County of McCracken, and their respective citizens, throu,-h the thoughtful and planned use and development of land, buildings, thorouThfares and public utilities. 1:. To encourage the estal•lishment of planning proarams, the provision of facilities and Personnel therefor, the study of needs of the affected areas in the .field of planning-, and the implementation and enforcement or all re,ulati.ons lawFull- established and promul- F'ated Fursuant to the pro -inions of said Chapter 100 of the Kentuckv 1039 Revised Statutes. c. To encourage cooperation between and among all persons and parties affected by the planning needs and operations of the community. d. To dedicate to the accomplishment of these purposes and ohlectives the lest efforts of the City of Paducah, Kentucky and its public officials and employees. SECTION 3. That a planning commission is hereby created within r� the purview of said Chapter 100 of the Kentucky Revised Statutes, which shall 'rye known as °Paducah Planning Commission", hereinafter referred to as "Commission", and as to which the following shall be applicable. a. The Commission shall consist of a total of five (5) members, to be appointed It,,, the Mlayor of the City of Paducah, with the approval of the Board of Commissioners of said City, in conformity with the applicable law, which membership shall be exclusive of any member who may be appointed by the County Judge in the event of the exercise of extra -territorial jurisdiction, as may be permitted by any applicable law. b. All members of the Commission shall be citizens of the City of Paducah, who are not elected officials, appointed officials, or employees of the said City. c. The City Manager and City Engineer shall assist the Commission in advisory capacities, attending the meetings of the Commission whenever their other official duties will permit. Other officials and employees of the City shall, upon request, lend their assistance to the Commission as their official dttl6 s will permit. d. The terms of the members of the Commission shall be for four (4) years each, ending on August 31 of the designated year, provided however, that the terms of those members appointed initially shall be staggered, so that one member shall serve for one year, one for two years, one for three ,years and two for four vears, with later appointments and reappointments continuing the staggered pattern, each new appointment being effective on Sertember 1 of the designated year. No member shall serve after the expiration of his term (unless reappointed), even though no new member ras been appointed to act in his stead. e, no member of the Commission shall receive any compensation. However, expenses lawfully incurred by a member in the performance of his duties may he authorized by formal action of the Commission. f. `!'ire Commission shall have the power to receive, hold, administer and disburse funds which it may lawfully receive from any and every source. Expenditures of such funds shall be in accordance with the formal action of the Commission, or pursuant t.o regulat.ions lawfully established 1,1�, the Commission. 10LO F. All other details respecting* the Commission and the function- inr_thereof shall Ie in conformity with Chapter 100 of the Kentucky Revised Statutes, as in effect from time to time. SECTION 4. That a hoard of adjustment is hereby created within the purview of said Chapter 100 of the Kentucky Revised Statutes, which shall be known as "Paducah Board of Adjustment", hereinafter referred to as "Board", and as to --hich the .following shall be applicable: a. The Board shall consist of a total of five (5) members, who shall be appointed by the Mayor of the City of Paducah, with approval of the Board of Commissioners of the said City, in conformity with the applicable law. b. All members. of the Board shall be citizens of the City of Paducah, who are not elected officials, appointed officials, or employees of the said City. c. The terms of the members of the Board shall tie for four (4) years each, ending on_Aufust 31 of the desi,nated year, provided however, that the terms of those members appointed initially shall be stappered, so that one_member.shall serve for one year, one for two years, one for three years and two for four years, with later appointments and reappointments continuing the stappered pattern, each new appointment being effective on September 1 of the designated year. No member shall serve after the expiration of his term (unless reappointed)., even though no new member has ween appointed to act in his stead.. d. No member of the.Board shall receive any compensation. F.owever, expenses lawfully incurred by a member in the performance of his duties may be authorized by formal action of the Board. e. All funds which the Board may lawfully acquire shall be paid into the treasury of the Commission, provided, however, that any funds received by the Board wl-ich are earmarked for specific purposes shall be subject to expenditure only for those purposes. f. All other- details respecting the Poard and the functioning thereof shall be in conformity with Chapter 100 of the Rentucky Revised Statutes, as in effect from time to time. SECTIOI! 5. That funds needed in the operation of the Plannirp Unit, the Commission and the Board which are not lawfully o'ntained from otY.er sources shall ie supplied by the City of Paducah, at such rimes and in such amounts as may he determined by the Po9rd of Commissioners of said City. All funds of the Plarninp Unit., tine Commission and the Board shall 'he paid to the Treasurer of the Commission, who shall I,e appointed by the Commission, Hut who shall not be con- sidered an officer of the Commission within the purviaw of said C'r.apter 1041 100 of the Kentucky Revised Statutes, and who need not be a member of the Commission. SECTION 6. That all planninr,, zoning, subdivision and other pertinent laws, rules, regulations and restrictions lawfully in force at the time of the adoption of this ordinance, including, but without limitation, the Paducah Zoning_ Ordinance"1961,•as amended. -(Ordinance Book 1L:, page 507) and the Paducah Subdivision Ordinance, as amended, (Ordinance Book 14, Page"485)-, shall -not be, -and shall not. be deemed to iie, affected or superseded by anything herein,contained,- except as to the official names of the Commission and Board,_ and they shall continue in.full force and"effect-until•superseded by appropriate action of the proper•o.fficial bodies. SECTION 7. .That the Paducah-M?cCracken,X ounty Planning Commission and the Paducah -McCracken County -Board of Adjustment, as they existed prior to the adoption of this Ordinance, shall be, and they are,hereby, dissolved. ; SECTION A. That this ord-finance shall constitute a "regulation" for its intended •purpose within the purview of said Chapter 100 of the Kentuckv Revised Statutes. SECTION 9.
