HomeMy WebLinkAboutOrdinances Book 14, Page 799, No Ordinance Numberr] AN ORDINANCE PROVIDING FOR AND AUTHORIZING THE TRANSFER OF X213,$20.00 FROP'i THE PUBLIC WORKS CUP'IULATIVE RESERVE FUND OF THE CITY OF PADUCAH, KENTUCKY, TO THE URBAN RENEWAL AND COP'WUNITY DEVELOPTMNT AGENCY OF SAID CITY FOR THE ACQUISITION OF ALL THE LAND IN AN AREA IN SAID CITY BOUNDED ON THE NORTH BY UASHINGTON STREET, ON THE EAST BY FOURTH STREET, ON THE SOUTH BY CLARK STREET AND ON THE WEST BY FIFTH STREET, AS A SITE FOR THE CONSTRUCTION OF A NEW CITY HALL BUILDING, AIID FOR THE COST OF CLEARING SAID SITE AND OTHER INCIDENTAL AND NECESSARY EXPENSES IN CONNECTION THEREWITH WHEREAS, on February 27, 1962, the Board of Commissioners of the City of Paducah, Kentucky, adopted a resolution approving a request to the Housing and Home Finance Administrator by the Urban Renewal and Community Development Agency of said city for approval of the undertaking of an Urban Renewal project known as the Downtown Civic Center Project in said city, noir known as Project Ky. R-30, and WHEREAS, on Ilay 22, 1962, the Housing and Home Finance Agency, by letter, certified the availability of Federal funds pursuant to Section 101 (c) of the National Housing Act of 1949 for capital grant in the amount of *891,755.00, and WHEREAS, on June 25, 1962, the aforesaid Urban Renewal and Community Development Agency adopted a resolution requesting the Housing and Home Finance Agency for consent to acquire certain land within the project area during the project planning stake, which property is the area in Paducah, Kentucky, bounded on the north by ."Jashington Street, on the east by Fourth Street, on the south by ClarkStreet and on the crest by Fifth Street, and '^HEREAS, the City of Paducah, Kentucky, intends to subsequently purchase said property described above at a fair and reasonable price for the purpose of constructing a new city hall upon_ same, and WHEREAS, the estimated cost of such early land acquisition, site clearing and other incidental and necessary expenses in connection therewith have been determined, and it has further been determined that such early acquisition for a city hall site will reduce the total project cost thereby making said project more feasible economi- cally, and 11HEREAS, Chapter 99 of the Kentucky Revised Statutes permits the acquisition of land by the aforesaid Urban Renewal and Community Development Agency during the project planning stage, and 11HEREAS, by an ordinance adopted by the Board of Commissioners of the City of Paducah, Kentucky on December 27, 1960, a Public 'rlorks 799 800 Cumulative Reserve Fund of said City was established as authorized by Sections 66.410 through 66.460 of the Kentucky Revised Statutes to acquire, construct, maintain, alter, repair or improve any municipal public works, including but not limited to municipal buildings such as a city hall building, and WHEREAS, said ordinance and Section 66.430 of Kentucky Revised Statutes provide that money in said Public Works Cumulative Reserve Fund may be withdrawn from such fund for its expenditure by 'the city proper, through any of its departments, or agencies, or by any in- dependent agency, board ā€˛commission or authority, to which the city has, or may have, authority to appropriate money for capital outlay, and WHEREAS, it is now desired by the Board of Commissioners of the City of Paducah, Kentucky that the sum of 6213,820.00 be transferred from the Public Works Cumulative Reserve Fund of said City to the Urban Renewal and Community Development Agency of said city for the acquisition of the land described above. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COPI-IISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the sum of $213,820.00 be transferred from the Public Works Cumulative Reserve Fund of the City of Paducah, Kentucky to the Urban Renewal and Community Development Agency of said city for the acquisition of all the land in an area in said city bounded on the north by Washington Street, on the east by Fourth Street, on the south by Clark Street and on the west by Fifth Street, as a site .for the construction of a new City Hall Building, and for the cost of clearing said site and other incidental and necessary expenses in connection therewith, such area being a part of an Urban Renewal Project known as the DownGo`An Civic Center Project in said City and known as Project Kir. R-30; and that the City Manager and the City Treasurer be, and they are hereby authorized to effect such transfer. SECTION 2. The sum of $213,820.00 referred to in Section 1 hereof shall be refunded to the City of Paducah, Kentucky by the Urban Renewal and Community Development Agency of said City upon receipt lJ-r said agency of Federal funds granted for the project mentioned in Section 1 hereof. SECTION 3.
