HomeMy WebLinkAboutOrdinances Book 14, Page 789, No Ordinance Number789 ADI ORDINANCE RELA^1ING TO THE MABLISHING OF THE GRADE OF PROPOSED HIGHUAY PROJECT DESIGNATING THE DEPART11ENT OF HIGH?'JAYS AS AGEi?T OF THE CITY OF PADUCAH, KENTUCKY, ARID CONVEYING CERTAIN STREET RIGHT OF '."JAY TO THE CODU'iODIPJEALTH; ALID THE ASSUD•'IPTION OF CERTAIN LIABILITIES BY THE CITY WHEREAS the Department of Highways (hereinafter referred to as "department") has made a survey and prepared plans on Highway Project, U 144 (11) Lone Oak Road in the City of Paducah (hereinafter referred to as "City") and described as follows: Extending from Highland Blvd. in a southerly direction to the intersection of the Friendship Road,'a distance of approximately 1.9 mile and designated by the Depart- ment of Highways as U 144 (11), and more particularly described: All that part of said tract or tracts which lie within a distance of 75 feet on the right side of the centerline of said proposed public road between the northeast right of way line of Kennedy Road at approximate station 63+28 and the southwest right of way line of Kennedy Road at approximate station 63+88; including therein all of the rights, title and interest held by the city in the approaches to any other described city street crossed by said project. This Ordinance is to apply to the above stated highway pro- ject insofar as same is within the corporate limits of the city; and WHEREAS the cost of construction of this road improvement is to be borne solely by the Department and the U. S. Bureau of Public Roads; and WHEREAS b; virtue of statutes all right of way in any street, or portion thereof, owned by the municipality and which becomes a part of the state highway system must be deeded to the Commonwealth of Kentucky for the use and benefit of the Department; and WHEREAS certain agi,eements must be made between the City and the Department and certain obligations must be assumed by the City with respect to traffic regulation and the adjustment of publicly � opined utility facilities lying within the right of way of the proposed project; i I 1 N0?9 THEREFORE, BE IT URDAINED BY THE BOARD OF COI•PiIISSIOMERS OF THE CITY OF PADUCAH, K.EPITUCKY I SECTION 1. That the Mayor be and he is hereby directed to execute and deliver on behalf of the City a deed conveying all of i the city's right, title and interest in and to so much of the right I of way as is owned by it and traversed by the project as is shown on the plans on file in the office of the City Clerk of the City, ,I said streets affected hereby being the same as described as follows: II 790 Extending from Highland Dlvd. in a southerly direction to the Intersection of the Friendship Road, a distance of approximately 1.9 mile and designated by the Depart- ment of Highways as U 144 (11), and more particularly Described: A11 that part of said tract or tracts which lie within a distance of 75 feet on the right side of the centerline of said proposed public road between the northeast right of way line of Kennedy Road at approximate station 63+28 and the southwest right of way line of Kennedy Road at approximate station 63+88; including therein all of the rights, title and interest held by the city in the approaches to any other described city street crossed by said project. SECTION 2, That the City assumes the liability for any expense incident to the relocation of any cit«-o-:med utility lines, i.e., water, sewer, gas, storm sewer or others, within the City owned rights of way on the above stated project which might be necessitated by the construction. The Mayor is hereby granted authority to enter into a contract (designated as Lw.D-8), on be- half of the City, with the Department putting into effect the pro- visions of this section SECTS That the City recognizes that certain traffic regulations will be required by the construction of the project within the city limits and hereby grants to the ilayor authority to enter into a contract (designated as Lir.D-4b) on behalf of the City with the Department putting into effect the provisions of this section. SECTIOii L. Any ordinances or parts of ordinances in conflict herewith are, hereby repealed to the extent of such conflict. SECTION 5. This ordinance shall be introduced and remain on file for public inspection for at least one (1) week in the completed form in which it shall be put upon its final passage and, if adopted, shall be in full force and effect ten (10) days there- after.
