AN ORDINANCE ESTABLISHING A PARKS, PLAYGROUND AND RECREATION
BOARD FOR THE CITY OF PADUCAH, KENTUCKY, AND PRESCRIBING THE IJEAIBER-
SHIP, TER413 OF OFFICE, POWERS AND DUTIES OF SUCH BOARD
WHEREAS, Chapter 124 of the 1958 Acts of the General Assembly
of the Commonwealth of Kentucky (now known and referred to as KRS 97.010
to KRS 97.055) provides that the Legislative body of any city may, by
ordinance, establish a Playground and Recreation Board, or a Parks,

Playground and Recreation Board, and to vest therein the power to
provide, maintain and conduct parks, playgrounds and recreation
centers, and
WHEREAS, it is the desire and intent of the Board of Commissioners
of the City of Paducah, Kentucky, to establish such a board for such
purposes and to possess the powers provided for by said Act and to
be subject to all the responsibilities set forth therein.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF CONirrISSIONERS OF
THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That pursuant to Chapter 124 of the 1958 Acts of the
General Assembly of the Commonwealth of Kentucky (now known and referred
to as KRS 97.010 to KRS 97.055) there is hereby established a board
to be known as the Parks, Playground and Recreation Board of the City
of Paducah, Kentucky, to provide, equip, maintain and conduct the
public parks, playgrounds and recreation centers of the City of Paducah,
Kentucky, in the manner provided for by said Act. Said Board shall
possess all the powers provided for by said Act and shall be subject
to all responsibilities set forth therein.
SECTION 2. The Board shall consist of five (5) persons to be
appointed by the Mayor 'to serve for terms of four (4) ,years and until
their successors are appointed, except that the members first appointed
shall be one for one year, one for two years, one for three years and
two for four years. Vacancies shall be filled in the same manner as
original appointments and for the unexpired term.
SECTION 3. To the extent permitted by law, the Parks, Playground
and Recreation Board shall be a body corporate for all purposes,
shall elect from its riembership a Chairman, Secretary and Treasurer;
the Treasurer shall execute a bond conditioned on the :faithful perform -
ante of his duties sufficient in amount to cover funds coming into
his hands; and the premium on such bond shsll be paid from Board funds.

SECTION 4. Unless authorized by a proper motion, resolution or

ordinance of the Board of Commissioners, the Parks, Playground and
Recreation Board established by this ordinance shall incur no indebted-
ness chargable to the general funds of the City of Paducah, Kentucky.
SECTION 5. All ordinances and parts of ordinances in conflict
herewith are, to the extent of such conflict, hereby repealed.
SECTION 6. That if any section, paragraph or provision of this
ordinance shall be found to be inoperative, ineffective or invalid
for any cause, the deficiency or invalidity of such section, paragraph
or provision shall not affect any other section, paragraph or provision
hereof, it being the purpose and intent of this ordinance to make each
and every section, paragraph and provision hereof separable from all
other sections, paragraphs and provisions.
SECTION 7. This ordinance shall be in full force and effect
on and after October 1, 1962.
