HomeMy WebLinkAboutOrdinances Book 14, Page 688, No Ordinance Number6$$j AN ORDINANCE PROVIDING FOR AND AUTHORIZING THE EMPLOYMENT OF BURNS & McDONNELL ENGINEERING COMPANY OF KANSAS CITY, MISSOURI, IN CONNECTION WITH THE PLANNING AND CONSTRUCTION OF STEPS I AND II IN PROPOSED STORM WATER RELIEF IMPROVEMENTS, AND AUTHORIZING THE EXECUTION OF A CONTRACT COVERING SUCH EMPLOYMENT BY THE MAYOR OF THE CITY OF PADUCAH, KENTUCKY BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the firm of Burns & McDonnell Engineering Company of Kansas City, Missouri, shall be employed in connection with the planning and construction of Steps I and II in proposed storm water relief improvements, and that the Mayor be, and he is hereby, authorized to execute, on behalf of the City of Paducah, Kentucky, an agreement and contract of employment of the said firm in words and figures as follows: "THIS AGREEMENT, made and entered into by and between the CITY OF PADUCAH, KENTUCKY, hereinafter designated as the 'City' and BURNS & McDONNELL ENGINEERING COMPANY of Kansas City, Missouri, hereinafter designated as the 'Engineers". W I T N E S S E T H: "THAT in consideration of the mutual covenants herein contained, the City hereby agrees to employ the Engineers to perform the services hereinafter outlined in connection with Steps I and II for storm water relief improvements as such is described in the 'Master Plan Report' Sanitary, Storm and Combined Sewers, submitted to the City by the Engineers on January 27, 1961 and hereinafter referred to. "The terms and conditions of this contract are as follows: "1 The Engineers agree to furnish all help, materials, and transportation necessary in rendering complete Professional Engineering Services in connection with the proposed construction of Storm Relief Sewers. "2. The xope of the proposed expansion is outlined in a report of the Burns & McDonnell Engineering Company to the City dated January 27, 1961, and specifically outlined on pages 27 and 2$ of the report under 'Steps I and II of the Proposed Construction Program'. 689 SECTION I -A Contract Documents and General Supervision 113 The Engineers shall prepare complete plans and/or specifications for all improvements. The plans and/or specifications shall define the quality of workmanship and material entering into each phase of the construc- tion, and shall completely define the work to be done, both as to quantity and quality of workmanship and materials involved. 114. The Engineers shall prepare instructions to bidders, bidders' forms, and other contract documents in ad- dition to the plans and specifications, and shall co- operate with the City Attorney in the preparation of contract and performance bond forms. 115. The Engineers will furnish complete sets of plans and specifications in sufficient quantity to supply the requirements of all bidders desiring to bid on the proposed construction work. '16. The Engineers agree, when the plans and specifica- tions are submitted for bids, to interest experienced contractors specializing in the work to submit pro- posals thereon, and when bids are received, to attend the letting, assist in the tabulation of the bids, make an analysis thereof, and file a written report on the merits of various bids, including therein recommen- dations relative to the acceptance of bids. "7. The Engineers shall assist the City, the resident engineer, and the contractors in a correct interpre- tation of the plans and/or specifications. Shop drawings of all equipment and materials fur- nished by the varions contractors shall be checked by the Engineers to safeguard the City against de- fects and deficiencies on the part of the contractor furnishing such items. Representatives from the office of the Engineers shall make periodical visits to the site of the work during the construction period. The representatives of the Engineers will be available for conferences with the City or the resident engineer for consulta- tation, advice, and recommendations as may be neces- sary or advisable in the proper prosecution of the work. 117a. The Engineers shall furnish the City with a complete set of as -built drawings suitable for the preparation of reproductions thereof; and the Engineers shall fur- nish the City with complete copies of all field books prepared by the Resident Engineer and Inspectors. SECTION I -B Resident Supervision "$. The Engineers agree to provide, prior to the begin- ning of construction, a resident engineer qualified to take complete charge of the work and such assist- ants as may be authorized by the City. It is agreed that the resident engineer's services shall terminate at the final completion of the work, or at any time the City may so request. The resident engineer shall supervise the setting, or set, all lines and grades necessary for the proper defining of the work to be done by the contractors, and check their compliance therewith. He is to de- termine the classification of excavated materials, and perform all other professional services required in the field incident to the successful and proper com- pletion of the project. The resident engineer shall prepare monthly esti- mates of the work performed under the dbntract, and certify as to the payment due to the contractors. Interim reports shall be made to the City at least once a month during the period of construction. The services included in this paragraph are to be furnished only if specifically authorized by the city, and may be entirely eliminated without affecting the remainder of the contract. SECTION II "IT IS FURTHER AGREED, by and between the Cuty and the Burns & McDonnell Engineering Company aforesaid, as follows: That the obligations of the City under this contract shall be as follows: 691 "9. The City agrees to make available to the Engineers all operating records, data, previous engineering i studies, reports, and all available data useful to the Engineers. 1110. The Engineers shall prepare specifications for and interpret the results of all subsurface explorations, soil tests, and all shop, mill or laboratory tests of materials of construction and equipment where such explorations and tests are necessary; however, the City shall pay the actual cost of such explorations, tests and laboratory services. The City reserves the right to require the Construction Contractor to assume the responsibility of and to pay for such services. "11. In compensation for the services rendered under Section I -A, the City shall pay the Burns & McD- onnell Engineering Company in accordance with the minimum fee schedule of the Kentucky Society of Professional Engineers as revised in 1957. This schedule is based on a percentage of the final con- struction cost of any work authorized. The per- centages are, as follows: I Cost of Construction Basis Minimum Fee $1,500,000 5.3% $2,000.000 5.25% $3,000,000 5.25% Construction Cost is defined as "The total cost of the project including all labor, equipment, materials, miscellaneous and general contracts, etc. but exclu- sive of any engineering or legal fees, land, rights-of- way, or interest during construction.' l "12. For the services of the Resident Engineer as outlined IIin Section I -B, paragraph 8, the City shall pay the Engineer the sum of $1,000.00 per month, plus traveling expenses of said Engineer from Kansas City, Missouri to I Paducah, Kentucky, and return, but shall pay only for i such expenses one trip each way. 1112a. For additional field services authorized by the City including inspectors, clerks, etc. the City shall pay the actual payroll cost (payroll cost being defined 1 692 as the salaries indicated on the time cards plus 15% to cover vacation, sick leave, old age benefits, etc.) plus 25% to cover administrative overhead and profit. 1?13. If, during preparation of, or after completion of complete working drawings, plans and/or specifica- tions, any changes are required by the City, such changes shall be made. The City shall pay the Engineers an amount equal to the actual cost of such changes, including overhead expenses. No profit is to be included for this service. Payments shall be made as follows: (a) A sum equal to four per cent (4%) of the esti- mated cost of the improvements for which plans and/or specifications are prepared, is due and payable upon completion and presentation of the plans and/or specifications to the City. (b) A final payment equal to 5.3% of the cost of construction if such cost is less than $2,000,000 or 5.250 of the cost of construction if such cost exceeds $2,000,000, after deducting: (1) The sum of $10,000 previously paid the Engineers for the 'P•4aster Plan Report Sanitary, Storm and Combined Sewers'. (2) Payments made under paragraph (a) above. The final payment is due and payable when the construction work is complete for the various phases of the project and a written report recom- mending acceptance is made by the Engineers. For services rendered under Section I -B, Paragraph 8, and 'Additional Compensation', Paragraph 13, payments shall be made on or before the 15th of the month following the month in which the services were rendered. "IN WITNESS WHEREOF, the City of Paducah, Kentucky, by Robert C. Cherry, Mayor, and the Burns & McDonnell Engineering 693 Company, by Hartwell J. This ordinance shall be introduced and remain on file for at least one (1) week for public inspection in the com- pleted form in which it shall be put upon its final passage, and if adopted shall be in full force and effect ten (10) days thereafter.
