AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK,
OF THE CITY OF PADUCAH, KENTUCKY, TO EU -CUTE A QUIT CLAIM DEED TO
COMMONWEALTH OF KENTUCKY, FOR THE USE AND BENEFIT OF THE DEPARTMENT
OF HIGHWAYS, ALL THE INTEREST OF THE CITY IN CERTAIN PROPERTY NEEDED
FOR THE IMPROVEMENT OF A PUBLIC HIGHWAY WITHIN THE CITY
91HEREAS the Department of Highways of the Commonwealth of
Kentucky is planning to reconstruct and improve a public road in the
City of Paducah, Kentucky known as U. S. 45 and known as Ky. Project
No. 73-112-L7, and
IVHEREAS said department has requested 'that the City convey
certain land needed in the improvement of said public road with no
monetary consideration but in consideration of benefits to be derived
by the city from such construction.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF
THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Mayor and City Clerk of the City of Paducah,
Kentucky, be, and they are hereby, authorized on behalf of said City,
to convey by quit claim deed to Commonwealth of Kentucky, for the use
and benefit of the Department of Highways, without monetary consideration
but in consideration of benefits to be derived by the City from the
construction of a public road therein, all its interest in and to the
following described land:
"Parcel No. 5
All that part of said tract or tracts which lie west of a
line run 36 feet left or east of and parallel with the
centerline of the proposed public road between the beginning
of construction at station 4=89.2 and the south property line
at approximate station 6+25.
It is understood between the parties hereto and made a covenant
herein that Parcel No. 5 described above is conveyed in fee
simple and not merely for right of way purposes.
Also the following parcels of land lying immediately adjacent
to the above described parcel on the side, to the width, and
between the stations shown below.

It is the specific intention of the grantor herein to convey a
temporary easement to the property described above and desig-
nated as parcel (a) for the purpose of use during construction,
and said easement terminates and reverts upon completion of same

Also the following parcel of land lying immediately adjacent to the
above described land and being more particularly described as
follows:

All that part of said tract or tracts which lie within a distance
of 15 feet on either side of a line described as follows:
Beginning at a point 36 feet from, and left, east of the center-
line, opposite approximate station 6+20 and running north 65° 60,
east 125 feet to a point and there terminating.
It is the specific intention of the grantor herein to convey a
permanent easement to property described above and designated as
Parcel (b) for the purpose of constructing and perpetually
maintaining storm sewer."
SECTION 2. The quit claim deed of conveyance authorized in
Section 1 hereof shall contain no covenants of warranty as to title.
SECTION 3. This ordinance shall be introduced and remain on file
for at least one (1) week for public inspection in the completed form
in which it shall be put upon its .final passage, and if adopted shall
be in full force and effect ten (10) days thereafter.
