HomeMy WebLinkAboutOrdinances Book 14, Page 671, No Ordinance Number671 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH-McCRACKEN COUNTY PLANNING COMMISSION RESPECTING THE AMENDMENT OF SECTION 22-A-1,, SECTION 22-A-5 AND SECTION 24-A-3 OF THE PADUCAH ZONING ORDINANCE - 1961, AND AMENDING SAID SECTIONS BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the Paducah -McCracken County Planning Commission on January 17, 1962, entitled "A RESOLUTION li CONSTITUTING THE FINAL REPORT OF THE PADUCAH-McCRACKEN COUNTY PLANNING j COMMISSION RESPECTING THE REVISION OF SECTION 22-A-4, SECTION 22-A-5 'I I AND SECTION 24-A-3 OF THE PADUCAH ZONING ORDINANCE - 1961" shall be, and it is hereby, approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That Section 22-A-4 of the Paducah Zoning Ordinance - 1961, (Ordinance Book 14, page 507) shall be, and it is hereby, amended so that in its amended state it will read as follows: "4. Drive -In Restaurant, tea room, cafe, ice cream shop or confectionary shop - Provided dancing and entertainment are excluded and provided all activities in connection therewith, other than the serving of patrons in automobiles, are conducted within a building. Plans for building construction and/or alteration, parking areas, ,yards, driveways, entrances and exits shall be submitted to the Executive Secretary, who shall examine them and pass them, together with his recommendation, to the Enforcement Officer, the City Engineer and the Commission Chairman, who, as a Committee, may approve the same or may require such changes therein as may be deemed necessary or desirable to insure safety, to minimize traffic difficulties, and to safeguard adjacent properties. The Committee may act by decision of a majority, and if there is no majority decision, the Commission shall function in lieu of the Committee. Any decision of the Committee may be appealed to the Commission. In the event of the absence of any member of the Committee, the Executive Secretary shall act in his stead. The use area shall be developed as re- quired in Section 9. SECTION 3. That Section 22-A-5 of the said Paducah Zoning Ordinance - 1961 shall be, and it is hereby, amended, so that in its amended state it will read as follows: "5. Automobile Service Station - In accordance with the State of Kentucky regulations concerning the use, handling, storage and sale of flammable liquids, provided that any tire or tube repairing, battery charging and storing of merchandise or supplies is conducted wholly within a building, and provided 672 that such use does not include tire recapping, metal repair, valve grinding, spray painting or similar operation, which by nature may become noxious to occupants of adjacent property or the general public. It is further provided that a Building Permit shall not be issued to permit the erection and occupancy of such use within two hundred (200) feet of any school, church or other place of public assembly. Plans for the erection and/or structural alteration of any automobile service station, in- cluding driveways, entrances, exits, parking areas, yards, con- struction, and location of pumps, buildings and other structures, shall be submitted to the Executive Secretary, who shall examine them and pass them, together with his recommendation, to the Enforcement Officer, the City Engineer and the Commission Chairman, who, as a Committee, shall function in the manner set forth in Section 22-A-4. The service station use area shall be developed as required in Section 9. SECTION 4. That Section 24-A-3 of the said Paducah Zoning Ordinance - 1961 shall be, and it is hereby, amended, so that in its amended state it will read as follows: "3. Drive -In Business - Including Motels, drive-in theatres, refresh- ment stands, food stores, banks and the like, where patrons may enter the premises or be served in automobiles. Plans for building construction and/or alteration, parking areas, yards driveways, entrances and exits, shall be submitted to the Executive Secretary, who shall examine them and pass them, together with his recommendation to the Enforcement Officer, the City Engineer and the Commission Chairman, who, as a Committee, shall function in the manner set forth in Section 22-A-4. The drive-in business use area shall be developed as required in Section 9. SECTION 5. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the defidiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, para graph and provision hereof separable from all other sections, paragraphs and provisions.
