A RESOLUTION ACCEPTING THE PROPOSAL OF THE PADUCAH WATER WORKS
FOR THE COLLECTION OF SEWER SERVICE CHARGES, PROVIDING THE TERMS AND
CONDITIONS OF SAID PROPOSAL AND PROVIDING FOR THE PAYMENT TO THE PADUCAH
WATER WORKS FOR ITS SERVICES
WHEREAS, by letter dated June 20, 1958, addressed to the
Mayor and Board of Commissioners of the City of Paducah, Kentucky,
the Paducah Water Works has proposed to collect sewer service charges
as contemplated in Section 2 of an ordinance establishing a schedule
of rates and charges for the use of and services rendered by the
municipal sewerage system, adopted by the Board of Commissioners on
April 12, 1958, and it appearing to be to the best interest of the
City to accept such proposal,
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF C0MMISSIONERS
OF THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the following proposal from the Paducah
;dater Works concerning the collection of sewer service charges by said
Water Vlorks in connection with the aforesaid ordinance be, and the same
is hereby, accepted, and said proposal is in words and figures as
follows:
"June 20, 195$
"Honorable FMayor and Board of Commissioners
Paducah, Kentucky
Gentlemen:
"You have requested Paducah Water Works (hereinafter refer-
red to as "Water Works?) to submit a plan for the collection of a
sewer service charge when such charge is made by the City of Pad-
ucah (hereinafter referred to as +City}). The proposals which fol-
low have been prepared in the manner that the Commissioners of
'dater Woaks feel will be most efficient and economical and are as
follows:
"1. The City shall determine the rate to be charged month-
ly to each sewer service account, and shall notify idater Works of
such individual rate by placing same on each respective account
card in the card file now kept at :^later works for garbage collec-
tion charges. ;'later Works will thereafter bill such sewer service
customer at the rate so specified by the City. In the event that
the rate on any account is found to be erroneous or is changed in
conformity with the rate schedule that may be adopted by the City,
then Water Works will bill the customer at the new rate on the
first billing after the City has indicated the change on the card
maintained for that account. !Yater Works will exercise no discretion
as to the rate charged to any customer and will be governed entirely
by the rate shown on the card prepared by the City.
"2. The City will adopt a flat rate to be charged to all
residential users. If a variable rate for commercial, industrial
or other large users of water, is adopted, such customers will be
divided into classes and each will be billed at the .flat rate
applicable to the class of that individual customer. If the classi-
fication of any customer is changed, it shall be the duty of the
City to so indicate on the account card kept at :Vater Works before
any change in the billing will be made.

3. Water 'Works will collect sewer service charges in the
same manner and at the same time as charges for water service are
collected. In the event that any customer receiving water service
and sewer service is disconnected or moves from the premises or be-
comes delinquent in the payment of an account, sewer service charges
owed by that custoner will be handled in the same manner as delin-

bills are handled by Water Works and will be reported
at such time as the charges may subsequently be collected
delinquent water bill is charged off the books of
Water Works will handle all sewer service charge
conformity to its system of billing and collecting
114. Water Works will assume no responsibility for the
collection of any sewer service charge account beyond the collection
of the account when due and such other action as Water Works cus-
tomarily takes in connection with the collection of delinquent
water accounts and will maintain no actions at law for the collec-
tion of delinquent sewer service charges.
"5, Water Works shall be the agent of the City for the
billing and collection of said charges as set out herein and in -
the event that any action at law involving sewer service charges
or any act by Water Works relative thereto, is brought against
Water Works, the City will defend such action and wil indemnify
Water Works in the event that a judgment is obtained against
Water Works, except in those cases in which such judgment is
obtained because of failure on the part of Water Works to perform
its obligations as herein set out,
116. Water Works will furnish the City a monthly statement
showing the total amount of sewer service charges billed and the
total amount of such charges collected.
"7. That the City will compensate Water Works, for billing anc
collecting the sewer service charges as herein provided, the sum
of :300,00 per month. Water Works grill issue a check payable
to the City of Paducah each month and deliver same to the City
in the amount shown to be due by the statement referred to in
paragraph 6, less the monthly charge for collection due from the
City. The compensation to be received by Water Works is neces=
sarily tentative in the absence of any experience upon which to
base such charges. Six months after Water Works has collected
sewer service charges, Water Works and the City will review such
compensation for the purpose of making such change in the amount
as may seem advisable and proper.
11$. The City has designated the position of Field Office
Helper in the Refuse Division to whom Water Works may refer all
calls for information, complaints or other inquiries pertaining
to sewer service charges, and Water Works will have no obliga-
tion to handle such calls or inquiries.
