CONSTRUCTION OF THE SOUTHSIDE ELEMENTARY SCHOOL IN PADUCAH, KENTUCKY
TO BE FINANCED BY THE ISSUANCE OF CITY OF PADUCAH SCHOOL BUILDING
REVENUE BONDS; AUTHORIZING THE EXECUTION OF A CONTRACT AND PRO-
VIDING THE TERMS AND CONDITIONS OF SALE
WHEREAS following an advertisement for bids for the construction
of the Southside Elementary School, bids were received and opened by
the Clerk of the City of Paducah, Kentucky on February 27, 1958, and
WHEREAS the Board of Education of the Paducah Independent

School District has studied all of said bids and has determined that
the bid of Hal Perry is the lowest and best and most favorable bid
to the Board and to the City at a total cost of $17$,$90.00 consisting
of the base proposal for radiant heat of $173,940.00, the addition
of Alternate No. 2 of $4,200.00 for glazed tile, the addition of
Alternate No. 4 of 1750.00 for Porcelo panels and no deductions for

grading and for venetian blinds as listed in Alternate No. 1 and No. 3,
and
WHEREAS by a motion adopted by the Board of Education of
Paducah Independent School District held later in the day on February
27, 1958 has requested the Board of Commissioners of the City of
Paducah, Kentucky to accept such bid and to execute a contract for
the construction, and
WHEREAS, Section 162.160 of the Kentucky Revised Statutes
authorizes the execution of a contract by the City for the construction
of such school.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS
OF THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the bid of Hal Perry for the construction
of the proposed Southside Elementary School be, and the same is
hereby accepted and confirmed, such bid c&lltng for a total price
of $178,890.00.
SECTION 2. That the proposed form of contract between said
contractor and the city attached to this ordinance be, and the same
is hereby approved, and the Mayor and City Clerk are hereby authorized
and directed to execute said contract on behalf of the City
SECTION 3. That said Contractor shall be required to furnish
to the City by filing with the City Clerk a performance bond with
satisfactory surety guaranteeing one hundred percent performance of

the contract, such bond to be furnished within thirty (30) days after
the execution of the contract. If such performance bond is not
furnished within such time the City shall be relieved of all ob-
ligation under said contract.
SECTION 4. That the acceptance of said bid and the execution
of said contract is subject to the ability of the City to issue,
sell and deliver a sufficient amount of school building revenue bonds
together with other available funds to finance the cost of construction
of said school building. Said contract is to contain a provision
providing that same is not to be construed as imposing any financial
liability on the part of the city or any of its officials or employees
or any payments due the contractor other than disbursing funds
received from the aforesaid revenue bonds and any other funds received
from said Board of Education/
SECTION 5. That all motions, resolutions or ordinances in
conflict herewith are, to the extent of such conflict, hereby
repealed.
SECTION 6. This ordinance shall be introduced and remain
on file for at least one (1) week for public inspection in the
completed form in which it shall be put upon its final passage,
but it being necessary for the public health and safety of the
City of Paducah, Kentucky that said contract be awarded as soon
as possible, an emergency is hereby declared to exist and this
ordinance shall be in full force and effect from and after its
adoption.
