A RESOLUTION AUTHORIZING TIS INTERtiE-IITION OF THE CITY OF PADUCAH
IN THE ,CTIOid OF C. A. LEUTENMAYER, ET AL. VS. HARRY V4ATHIS, ET AL.,
CIVIL SCTIOVI 110. 2782, FOR THE PURPOSE OF ASSERTING THE VALIDITY OF THE
ORDINANCE UNDER WHICH THE USE CLASSIFICATION OF CERTAIH PROPERTY LOCATED
AT AVID IN THE VICINITY OF THE INTERSECTION OF THE BLANDVILLE AND LOVIE OAK
ROADS WAS CHANGED FROM R-1 AND R-2 ONE -FAMILY ZONES TO A B-1 NEIGHBORHOOD
BUSINESS ZONER:
WHEREAS, upon the recommendation of the Paducah Planning and
Zoning Commission of the City of Paducah, the Board of Commissioners,
by the unanimous vote of its members, adopted on November 23, 1957,
an ordinance changing the use classification of certain property at
and in the vicinity of the intersection of the Lone Oak and Blandville
Roads from R-1 and R-2 zone classifications to a B-1 zone classifica-
tion; and
WHEREAS, C. A. Leutenmayer and others have since instituted in
the McCracken Circuit Court a Declaratory Judgment action against Harry
V:athis and others, claiming in said suit that said ordinance is valid;
and
WHEREAS, the use of said property for business purposes will be
of such great benefit to the City of Paducah and its citizens that it
is deemed advisable for the City to intervene in said action for the
purpose of securing the Court's approval of its action changing the
zone classification of said property;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF C01411ISSIONERS OF
THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the City of Paducah intervene in the aforesaid
declaratory judgment suit for the purpose of asserting, for and in be-
half of its citizens, the validity of the aforesaid zoning ordinance
under which the use classification of the property at and in the vicinity
of the intersection of the Lone Dart and Blandville Roads was changed
from R-1 and R-2 One -Family Zones to a B-1 Neighborhood Business Zone,
and that the legal department file in said action an appropriate pleading
asserting on behalf of the City of Paducah the validity of said ordinance
which was adopted by it for the purpose of promoting the general welfare
of its citizens.
SECTIO?'? 2. This resolution shall be in full force and effect from
and after its adoption.
