HomeMy WebLinkAboutOrdinances Book 13, Page 752, No Resolution Number752 A A RESOLUTION RECITING THE NEED OF ACQUIRING CERTAIN LANDS IN THE CITY OF PADUCAH, KENTUCKY BY THE CITY UPON 1,1HICH TO CONSTRUCT A NEd CITY HALL BUILDING, SAID LAND BEING OWNED BY THE ESTATE OF tTILHELi iiA BERNHARD; MARTIN U. OPERLE; KATHERINE BERNHARD; WILLIAM A. CISSELL AND :+LIFE, FRACNES E. CISSELL AND THE ESTATE OF hIARY E. RADFORD; DESCRIBIAIG SAID LANDS; AUTHORIZING AND DIRECTING THE CITY MANAGER TO MAKE CERTAIN FIRIQ OFFERS TO SAID OPTNERS FOR THE PURCHASE OF SAiJM; AUTHORIZING THE CITY TREASURER TO PAY FOR SAiIM OUT OF CURRENT FUNDS OF THE CITY; AND AUTHORIZING THE CORPORATION COUNSEL TO TAKE THE NECESSARY STEPS TO CONDEIQN ALL OF SAID LANDS OF OWNERS WHO REFUSE SUCH OFFERS [VIIEREAS, on January 22, 1957, the Board of Commissioners of the City of Paducah, Kentucky, adopted a resolution declaring the desirability of acquiring certain lands to be used for -the con- struction of a new city hall building, and that a tract of land on the west side of South 16th Street extending from the south side of kentucky Avenue to the north side of Washington Street and fronting approximately 207 feet on Itentucky Avenue and Washington Street was a desirable location for such city hall building; and WHEREAS, said resolution authorized the Mayor and City Manager to employ two licensed real estate dealers for the purpose of appraising sack parcel of property contained in the above tract; and .VHEREAS, R. F. Christie and W. J. Pierce, Licensed Real Estate Dealers in Paducah, Kentucky were employed by the Mayor and City R4anager for the purpose of appraising said parcels; and IVHEREAS, on March 13, 1957 the said R. F. Christie and W. J. Pierce submitted in writing their appraised value of each of said parcels, which appraisal report was received and filed by the Board of Commissioners of the City of Paducah, Kenrucky on I -larch 16, 1957; and WHEREAS, on I•larch 23, 1957 the Board of Commissioners of the City of Paducah, Kentucky by motion directed and authorized the City i.lanager to secure options for the purchase of such properties at the value shown on the aforesaid appraisal report of R. F. Christie and V. J. Pierce; and :VHEREAS, by letter from the City Manager of June 3, 1957 to the Board of Commissioners of the City of Paducah, Kentucky, he reported he had not been able to secure any options for the purchase of any of said property, which letter has this day been received -and filed by the Board of Commissioners. 753 NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSI0?dERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the hereinafter described lands of the Estate of Wilhblmina Bernhard; Martin W. Operle; Katherine Bernhard; William A. Cissell and wife, Frances E. Cissell, and the Estate of Mary E. Radforl:, are needed by the City of Paducah, Kentucky as a site upon which to construct a new city hall building. SECTION 2. That the City Manager be, and he is hereby, authorized and directed to make firm offers to the owners of said property for the purchase of same by the City of Paducah, Kentucky for the amounts as shown upon the appraisal report of R. F. Christie and W. J. Pierce dated March 13, 1957, and received and filed by the Board of Commissioners of the City on March 16, 1957, the description of said property, the names of the owners and the appraised value amount to be offered by him is to be as follows: Tract No. 1 Owned by the Estate of i+lilhelmina Bernhard being described as follows: Beginning at the southwest corner of the intersection of 16th Street and Kentucky Avenue; thence westwardly with the south line of Kentucky Avenue 158.864 to the east line of the Operle land; thence southwardly-with the east line of the Operle land and parallel with 16th Street 173.251 to the north line of an alley; thence eastwardly with the north line of said alley and parallel to Kentujky Avenue 158.861 to a point on the west line of 16th Street; thence northwardly with the west line of 16th Street 173.251 to the point of beginning. The -.appraised value for said Tract No. 1 to be offered by the City is the sum of tij13,000.00. Tract No. 2. Owned by Martin W. Operle being described as follows: Beginning at a point on the south line of Kentucky Avenue 158.86 feet west of 16th Street and being at the north west corner of the Bernhard land; thence westwardly with the south line of Kentucky Avenue501; thence southwardly and parallel with 16£h Street 173.251; thence eastwardly and parallel with Kentucky Avenue 501 to the south west corner of the Bernhard property; thence northwardly with the west line of the Bernhard property and parallel with 16th Street 173.251 to the point of beginning on the south line of Kentucky Avenue. The appraised Value of said Tract No. 2 to be offered by the City is the sum of •;x4,000.00. TRACT No. 3 Owned by Katherine Bernhard and being described as follows: 754 Beginning at the north west corner of the intersection of 16th Street and Washington Street; thence northwardly with the west line of 16th Street 160, to the south line of an alley; thence west-wardly with the south line of said alley and parallel with 'Jashington Street 394; thence southwardly and parallel with 16th Street 160, to a point on the north line of Washington Street; thence eastwardly with the north line of Washington Street 391 to the point of beginning. The appraised value of said Tract No. 3 to be offered by the City is the sum of .,5500.00. Tract No. 4. Owned by Katherine Bernhard and being described as follows: Beginning at a point on the north line of Washington Street 391 west of 16th Street; thence northwardly and parallel with 16th Street 160, to the south line of an alley; thence westwardly with the south line of said alley and parallel with Ciashington Street 332; thence southwardly and para- llel Ath 16th Street 160, to a point on the north line of 1ashington Street; thence eastwardly with the north line of Washington Street 334 to the point of beginning, and being the property known as 1635 Washington Street. The appraised value of said Tract No. 4 to be offered by the City is the sum of ti)1,750.00. Tract .'do. 5. Owned by William A. Cissell and wife, Frances E. Cissell, and being described as follows: Beginning at a point on the north line of Washington Street 724 west of 16th Street and being the southwest corner of the Katherine Bernhard property; thence northwardly with the wrest line of said Bernhard property and parallel with 16th Street 160, to the south line of an alley; thence westwardly with the south line of said alley and parallel with Washington Street 394; thence southwardly and parallel with 16th Street 160, to the north line of Washington Street; thence eastwardly with the north line of Washington Street 397 to -the point of beginning, and being the property known as 1637 Washington Street. The appraised value of said Tract No. 5 to be offered by the City is the sum of .,x5,000.00. Tract !,Io. 6. Owned by the Estate of Kary E. Radford and being described as follows: Beginning at a point on the north line of Washington Street 1574 west of 16th Street, said point being the southwest corner of the property of the City of Paducah; thence northwardly with the west line of said City of Paducah property and parallel irlth Toth Street 173.254 to a point at the south east corner of the Operle property; thence westwardly with the south line of the Operle property and parallel with Washington Street 504; thence southwardly and Parallel with 16th Street 173.251 to a point on the north line of Jashington Street; thence eastwardly with the north line of Washington Street 504 to the point of beginning. The appraised value of said Tract No. 6 to be offered by the City is the sum of .,P*4,000.00. 755 SECTION 3. That the City Treasurer be, and he is hereby, authorized and directed to pay to any or all of the above owners the sums set out in Section 2 for the respective pieces of property upon presentation to him of a deed of conveyance of such property to the City of Paducah which has been approved by the Corporation Counse, and any sums of money so paid by him shall be charged to Account No. 7700 (Real Estate Acquisition); however, no such payments shall be made until after the effective date of this Resolution. SECTION 4. That the Corporation Counsel of the City of Paducah, Kentucky is hereby authorized, when directed by a motion adopted by the Board of. Commissioners, to take all necessary steps for the con- demnation of any of the tracts of land described in Section 2 hereof whose owner or owners refuse the appraised values to be offered as set out in said section. SECTION 5.
