AN ORDINANCE ACCEPTING THE BID OF ALGERTION BLAIR FOR THE COITSTRUCTIO;:
OF A NMI HIGH SCHOOL BUILDING IIT PADUCAII, TO BE FINANCED BY THE ISSUAI:CE OF
CITY OF PADUCAH SCHOOL BUILDING REVENUE BONDS; AUTHORIZING THE EXECUTION OF A
CONTRACT AND PROVIDING THE TERMS AND CONDITIONS OF SAME
WHEREAS, following an advertisement for bids for the construction of a
new Paducah High School building, the Board of Commissioners of the ,ity of
Paducah, Kentucky opened and filed all bids on August 10, 1953, and
WHEREAS, the Board of Education of the Paducah Independent School
District has studied all of said bids and has determined that the bid of Algernon
Blair of Ilontgomery, Alabama is the lowest and best and most favorable bid to the
Board and to the City at a total cost of •,;2,760,000.00, with certain alternates
eliminated and with certain minor modifications made in the specifications,
and
WHEREAS, the next lowest bid was more than 0500,000 higher than the.
bid of Algernon Blair, and
WHEREAS, it is desired by the Board of Education that said bid of
Algernon Blair as amended be accepted, and
WHEREAS, the Board of Education_ and said contractor have agreed upon
a form of contract to be entered into between said contractor and the City in
accordance with the bid of said contractor, and
WHEREAS, said form of contract has been presented to this Board and
is attached to this ordinance and the minutes of the meeting at which this
ordinance was proposed, and
WHEREAS, the Board of Education of the City of Paducah, Kentucky, on
January 12th, 1954 adopted a motion approving said contract and requested the
Hoard of Commissioners of the City of Paducah, Kentucky to authorize the execution
of same, and
WHEREAS, Section 162.160 of the Kentucky Revised Statutes authorizes
the execution of a contract by the City of Paducah, Kentucky for the construction
of said school building.
NOW THEREFORE, BE IT ORDAINED BY TIL BOARD OF CO1j ISSIO11ERS OF TIM CITY
OF PADUCAII, KEIiTUCKY:
SECTION 1. That the bid of Algernon Blair, contractor, of i•:ontgomery,
Alabama, as amended and modified for the construction of the proposed new Paducah
High School building, be and the same is hereby accepted and confirmed, the said
bid calling for a total price of 7?2,760,000.00.
S'ECTIOII 2. That the proposed fore of contract- between said contractor
and tge City attached to this ordinance be and the same is hereby approved, and
the I-iayo-r and the City Clerk are hereby authorized and directed to execute said
contract on behalf of the City.

SECTIOi? 3. That said contractor shall be required to furnish to the City
by filing with the City Clerk, performance bond guaranteeing 100 per cent per£ormanc
of the contract, such bond to be furnished within 30 days after the execution of
said contract. If said performance bond is not furnished on or before said date,
the City shall be relieved of all obligations under said contract-.
SECTIOi'. C,. That the acceptance of said bid and the execution of said
contract is subject to the ability of the City to issue, sell and deliver a
sufficient amount of School Building Revenue Bonds together with other available
fundstc finance the cost of construction of said school buildings as set out in
said contract. Said contract to contain a provision providing that same is not to
be construed as imposing any financial liability on the part of the owner or any
of its officials or employees for payments due contractor other than disbursing
funds received from the aforesaid revenue bonds and any other funds received from
Board of Education.
SECTION 5. That all orders, resolutions, ordinances or motions in con-
flict herewith are, to the extent of such conflict, hereby repealed.
SECTION 6. This ordinance shall be introduced and remain on file for at
least one (1) week for public inspection in the completed form in which it shall
be put upon its final passage, but it being necessary for the public health and
safety of the City of Paducah, Kentucky that said contract be awarded as soon as
possible to complete the aforesaid school project, an emergency is hereby declared
to exist and this ordinance shall be in full force and effect from and after its
adoption.
